235 Councilman Henderson questioned the propriety of using City funds to make the repairs instead of having the Contractor make the repairs , Councilman Williams felt that if an emergency had been found to exist , the expenditure should be authorized as provided in the Charter, leaving the further handling of the matter to the City Attorney . Responding to question , City Attorney advised that the resolution sets forth the fact that an emergency exists and under the circumstances , Council is authorized to expend public funds because of the emergency and the fact that determination of ultimate fault would take too long , Failure to effect repairs would have detrimental effect on the health of persons and the property in the area , Temporary facilities are of the nature they cannot endure prolonged use . Councilman Henderson inquired if City would be jeopardizing its position in ultimate reimbursement by accepting the responsibility for the emergency action , and City Attorney advised it would not . He pointed out Staff has undertaken an investigation to determine responsibility and to receive assurances from those parties which may be involved . After considerable further discussion, motion carried on roll call vote , Mayor Bury being noted absent . B , Councilman Weymouth moved to introduce Ordinance appropriating $6 , 000 from unbudgeted unappropriated balance of the Sewer Fund to provide for purchase of Supplies and Other Services for the Department of Public Works - Water Services Activity , seconded by Councilman Williams and carried . Sufficient funds are available for the emergency expenditure required to repair Pump Station No . 10 . However , it was recommended that provision be made for reimbursing the appropria- tion from which such funds are expended , This Ordinance provides for that action . Councilman Weymouth nominated John Quinn to continue on the Architectural Committee , He is current chairman and has indicated willingness to continue serving . He has served less than two terms , Vice -Mayor Keckley suggested publicizing the balance of the commission vacancies and asking people within the community who would be interested in serving on commissions to submit profiles and an expression of their areas of interest . In the future a file would be maintained of those who are interested in community participation , He suggested postponing the appointment schedule for a couple of weeks to allow time for response . Councilman Henderson supported the recommendation and moved that Council take action next week ( August 9) to appoint nominees to vacancies on Park and Recreation Commission and Architectural Committee , and that the other appointments be held open until August 23 to give people an opportunity to respond , seconded by Council- man Rhodes and carried .
