237 <br /> filed . Communications submitted prior to the public hearing were read into the <br /> minutes by the City Clerk , from Seymour Goldberg , E. C . Wenger Electronics Co . , <br /> 775 Arguello Street , and Mr , and Mrs . Henry Morello , owners of property at <br /> 817 Arguello , and 715-717 Arguello , both in support of the appellant ' s request . <br /> Mr . Richard J . Dormody , 1212 Whipple Avenue , <br /> attorney representing Stewart Title Co . , <br /> indicated the firm is a nation-wide corporation , <br /> and it was their intention to make this location <br /> the regional headquarters for Northern California . <br /> The property had been acquired seven years earlier . <br /> It was their understanding that three years ago , <br /> Transamerica Title in the same block had made a <br /> similar request which was approved . He described <br /> the character of the adjacent properties , and <br /> displayed a drawing of what was proposed to be <br /> built . He was assisted in his presentation by <br /> Mr . Lassiter , Vice President of Stewart Title , <br /> In response to questions by Council , applicant advised of the circumstances by <br /> which the property was acquired , and that they were aware of the zoning designation . <br /> They had also been informed that it would not be feasible to construct an apartment <br /> building at this location , for the income that could be expected to be derived . In <br /> additional discussion, Mr . Dormody indicated that at the Planning Commission level <br /> there had been no opposition , and felt their decision had been arbitrary . Councilman <br /> Weymouth noted that it appeared the Staff had based the recommendations on the <br /> findings of the adopted Downtown Plan , and Mayor Bury added that these were con- <br /> clusions of a professional study and involved a great deal of citizen participation <br /> and indicated this particular parcel for residential . <br /> Senior Planner was requested to respond to the comment regarding Transamerica <br /> Title , and he advised that approximately three years before , that firm had <br /> appeared before the Planning Commission for a Use Permit based on the building <br /> being a larger size , and a Variance relating to setbacks . No request for rezoning <br /> was involved . <br /> Mr . Guy Barbour , 280 Howland Street , stated he owned <br /> an apartment building in the area , and spoke in support <br /> of the rezoning . <br /> There being no further communications or discussion, Councilman Keckley moved to <br /> close the public hearing, seconded by Councilman Petersen and carried . <br /> Councilman Keckley moved to affirm the action of the Planning Commission and deny <br /> the application , seconded by Councilman Weymouth and carried on roll call vote , <br /> Councilmen Henderson , Keckley , Weymouth and Mayor Bury voting yes ; Councilmen <br /> Petersen and Rhodes voting no , and Councilman Williams being noted absent . <br /> (MINUTE ORDER #71-141 ) <br /> PUBLIC HEARING , Appeal of GUY and CECILE BARBOUR from denial by the Planning Commission <br /> of their application to amend the Zoning Map to rezone property located at 1631 and <br /> 1641 Union Avenue ; being the westerly one -half of Lot 11 , Block G , Woodside Acres <br /> No . 1 , from an "R-2 " (Residential -Duplex ) District to a "PO " ( Professional Office ) <br /> District , declared open and affidavits of publication and mailing ordered filed . <br />
