261 <br /> subdivide one parcel into two parcels , 511 and 513 Hillside Road , in <br /> an "RH " (Residential -Hillside ) District . <br /> Planning Commission at their meeting of August 2-i- , 1971 , voted un- <br /> animously to deny this application for exceptions to subdivide parcel <br /> as being contrary to the Supplementary Area Requirements for Sloping <br /> Sites of the Zoning Ordinance . Planning Commission report had been <br /> submitted to Council . <br /> Mr . Coy Russell , 511 Hillside Road , referred to <br /> several points in his letter of appeal to Council <br /> to justify the exception , and reviewed history of <br /> his ownership of the property and proposed development . <br /> In his responses to questions by Council , Mr . Russell indicated that <br /> for over twenty years they had owned the two lots , residing for that <br /> period on one , with intention of eventually developing the second <br /> lot . At the time the property was annexed approximately two years <br /> ago , the vacant property was a buildable site ; however , subsequent <br /> amendment to the Zoning Ordinance pertaining to sloping sites made <br /> it substandard . He stated there were no drainage problems . He <br /> indicated he was not aware of the change in zoning requirements <br /> until recently . Planning Director noted that the studies for the <br /> Zoning Ordinance amendments had been conducted over a period of two <br /> or more years , and that the matter of hillside development had been <br /> a matter of growing concern . Referring to a slide drawing of the <br /> property , he described the difficulties of the topography , but in- <br /> dicated that under the Ordinance , additional dwelling units would <br /> be permitted , up to a maximum of four . He felt that development <br /> opportunities for this site would be gratly enhanced through Planned <br /> Development procedures . <br /> Mr . Russell indicated that financing a Planned <br /> Development would be costly, requiring cutting <br /> and filling ; engineering and need for an architect , <br /> all for only four dwelling units . <br /> Councilman Keckley moved to uphold the Planning Commission and DENY the <br /> exception to the Subdivision Ordinance , seconded by Councilman <br /> Weymouth . Councilman Petersen spoke against the motion noting that <br /> more recently , property is prezoned prior to annexation which gives <br /> the property owner the option to decide whether to annex or not . <br /> This was not the case with the property under consideration , and he <br /> felt this was a special case . Motion carried on roll call vote , <br /> Councilmen Henderson , Keckley , Weymouth and Williams voting yes , and <br /> Councilmen Petersen , Rhodes and Mayor Bury voting no .
