Councilmen Arnett and Keckley noted absent. <br />Councilman Henderson requested that in the future when Staff brings additional <br />plans and specifications, Council be provided with maps, as well as information <br />regarding trees. (Memo 6-16-70) <br />Request for reduction of retention by 50% in the Marlin Subdivision No. 2 contract <br />with Hood Corporation, provided that remaining progress payments retain 10% <br />of completed construction. <br />Staff report stated no liens or claims had been filed against the contractor <br />and that surety had been advised and is agreeable to the request. Contractor <br />had withdrawn an offer on a change order funded by Leslie Properties, but <br />agreed to reinstate if City allows the reduction in the retention. Staff <br />recommended approval by Council, but consider this a special case and should <br />not be deemed a precedent. <br />Staff responded to questions by Council to advise that the present retention <br />amounts to approximately $60,000, and 500 of that is proposed to be released. <br />Mr. Allen detailed the requested action, stating the amount <br />is $62,000, proposed to be reduced to $31,000. At the end of <br />the job, the amount of the retention fund would be approximately <br />6.5%. A change order amounting to about $12,000 was delayed in <br />resolvement because of other work over which contractor had no <br />control, involving extension of service for telephone and <br />television cable. The contractor's work has been excellent, <br />and there is a letter on file from the surety indicating no <br />jeopardy to payment of the performance bond. <br />Councilman Weymouth moved to approve reduction of retention by 50% in the <br />Marlin Subdivision No. 2 contract with Hood Corporation, provided that <br />remaining progress payments retain 10% of completed construction, seconded <br />by Councilman Petersen and carried. (MINUTE ORDER #70-109) <br />Report and recommendation of Legislative Committee was presented by Councilman <br />Henderson, Chairman, of matters referred by Council to the Committee, as <br />well as matters pending before the State Legislature. The Committee met <br />on June 10, 1970, and their recommendations are as follows: <br />1. Referrals by Council or Staff; (a) Vista Points. Resolutions of Portola <br />Valley and Half Moon Bay had urged State Highways Commission direct that <br />design of vista points be included as standard procedure in preparation of <br />freeway and scenic highway plans. Committee concurred in this position and <br />recommends Council adopt a resolution of similar intent. A draft resolution <br />proposed by the Committee for adoption was submitted to Council. (b) San Mateo <br />County Ocean Frontage. Council had referred to Committee a, letter from City <br />of Pacifica urging support of their resolution requesting Governor to declare <br />3 <br />
