Mr. Fritz Gelb, 1748 Braodway, described the store as one of the oldest <br />stores in the City and one of the pioneers South of Main Street, and <br />that it was with City's permission sign was put up. They had bought out <br />the business in 1960 and were still paying on the very costly signs, which <br />he said would cost $30,000 to replace today. He stated the building is <br />surrounded by apartment houses and removal would cause a hardship from <br />visibility standpoint, and that because of the advertising they do, busi- <br />ness is brought in from all over the Peninsula, but their sign is neces- <br />sary for identity, <br />Mr. Gelb responded to questions from Council, and it was indicated that, while the owners <br />were aware of the adoption seven years ago of the Ordinance, the signs were on the build- <br />ing long before that time, <br />Councilman Petersen noted that there have been many lengthy discussions with the owners, <br />and it was felt that the question to be decided was whether or not this was a good Sign <br />Ordinance, and in the opinion of the Committee the Ordinance is a good one, and should <br />be enforced. He indicated the owners had been asked if a one-year extension would satisfy <br />them, but this was refused as not being a long enough time. Councilman Weymouth commented <br />that extension of more than one year should never be considered for violations as serious <br />as these, and that the owners had been warned seven years ago. <br />Fred Sello, 1606 Prospect, Belmont, stated he was a partner in the firm, <br />and that for their type of business the signs are necessary, that some <br />of their customers have difficulty finding them, and without the signs <br />it would be even more of a problem. He indicated if Council turned down <br />their request, they would have to fight for their livelihood. <br />In the discussion by Council it was noted that when the Ordinance was passed, a five <br />year amortization period was permitted. Mr. Sello requested a list of persons whose <br />signs were in violation, for use in any legal claims they might have, and was informed <br />that the process of determining violations is a continuing one, therefore, it would not <br />be possible to provide such a list. However, a list of owners of nonconforming signs <br />where investigations have already been made and their disposition could be obtained <br />from the Building Department. <br />The <br />fact that <br />the building fronts <br />on two <br />streets <br />was <br />brought out, <br />which <br />would <br />qualify <br />it <br />for 300 sq. <br />feet of sign. Mr. <br />Sello <br />advised <br />that <br />the flashing <br />of the <br />sign <br />could be <br />eliminated, but the height would be difficult to cut back. <br />Councilman Petersen moved to deny the extension requested of ten years, seconded by <br />Councilman Keckley and carried on roll call vote, Councilman Henderson being noted <br />absent. (MINUTE ORDER #70-138-E) <br />Councilman Keckley announced that another meeting of the Ordinance Review Committee would <br />be held the following morning, <br />Councilman Weymouth moved to adopt RESOLUTION NO, 6342 ASCERTAINING AND DETERMINING THE <br />GENERAL PREVAILING RATE OF PER DIEM WAGES IN THE LOCALITY, seconded by Councilman <br />Keckley. The amended Labor Code Section 1773 requires annual publication of updated <br />Wage Rates. Motion carried on roll call vote, Councilman Henderson being noted absent. <br />Councilman Arnett moved to adopt RESOLUTION NO. 6343 APPROVING AND AUTHORIZING EXECUTION <br />OF JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE CITIES OF BURLINGAME, DALY CITY, RED- <br />WOOD CITY, SAN BRUNO, AND SAN MATEO, AND THE COUNTY OF SAN MATEO, FOR THE ESTABLISHMENT <br />OF A COOPERATIVE LIBRARY SYSTEM, seconded by Councilman Keckley. Agreement is necessary <br />in forming the Peninsula Library System for which a grant of $74,057 was approved by <br />the State.
