116 <br />In concl tct q its review, your Committee has studic;d and <br />reviewed th; p:t:ovi.siory of Califorrlia Penal Code Section lc16 <br />(regi9:r:'dxIzg jllSti f:Labl.e hO1TliCide when e'ommit-teC <br />by pu}J17.Cr Off icers <br />anO, those acting by th3i r cc7mnand ill their. -aid and asslstc. - Ge) , <br />the present rules and regulations of the Police Department <br />reg arcail:g the use of firearms by peace officers, similar <br />departmental regulations of a number of police departments in <br />Northern California, and the proposed "police fireal-ms policy" <br />furnished by file "Citizells for Community Control of Police." <br />In addition to the foregoing, and because of its. close relation- <br />ship to the specific subject matter_ of regulation of the use of <br />firearms by peace officers, your. CO:mnittee considered the <br />question of the merits Of a "Police Review Board." <br />In carrying out its function, the Committee met and conferred <br />with members of the City's staff as well as members of the <br />"Citizens for COT1nuni.ty Control Of Police." and others. It is <br />the opinion of your CoiLmlttee that such meeting' -s and conterellces <br />were of considerable value in assisting the Committee in making <br />its reconuncndation. <br />With regard to City employee practices and, in .particular, <br />Police practices, the Committee notes that in addition to the <br />above mentioned Council policy relating to citizens' complaints, <br />complaints are also processed by City staff, the City's Personnel <br />Board, and a review board formed by and acting under the San Mateo <br />County Human Resources Commission. The latter review board <br />processes, in particular, questions or complaints relating to <br />Police practices within San Mateo County. Further, the Committee <br />observe -_d that eXtensive reviews of governmental functions, <br />including police matters, are conducted by numerous officials <br />and bodies depending upon the subject matter involved. <br />It is the unanimous conclusion and reconunendation of your <br />Committee that no changes are necessary or r.eruired to the present <br />rules of the Police Department relating. to the use of f firearms <br />by peace officers, and that no changes to the organizational <br />structure of the City relative to the review of complaints or <br />charges against City en:uloyees are necessary or required. If <br />the Council desires to ,receive comment or statements from the <br />publ.i.c relative to the subjects discussed herein, it is reco121- <br />mended that for such purposes strict .rules of procedure apply, <br />in view of the expressions made to,1-o; r Committee relative to <br />the interest of the Comnruni.ty in the s -11D ect matter. <br />lly sub.nj'tted, <br />2'RT H. A reading of the <br />"Rules and Regulations Governing Use of Deadly Force - Firearms" of <br />the Redwood City Police Department, was requested, and City Manager <br />complied. <br />
