. ctrti.l l':t 1J:)it - Jt Gt7;ScR 11 1969 <br />r <br />R E W 0 0 D C-1 T Y P O L I C E D E P A R VM E N T <br />- RULES .LND REGULATIO`IS - Governing the use of deadly force - Firearms <br />A, DUTY OF ALL OFFICERS IN USING FIREARMS: <br />Every officer shall bear in mind that though the law allows the use of <br />— the firearm for apprehension for violators of certain laws, that his <br />(officers) first duty lies in the protection of life and property; there- <br />fore, he must consider all of the consequences involved before resorting <br />.to its use. All available means at•the officers disposal, i.e. Baton, <br />Tear Gas, Persuasion, etc,; shall be utilized before the firearm, <br />B, USE OF THE FIRER. 1- <br />When an officer observes someone about to take a human life and that <br />person fails to obey a lawful order to cease or•desist from such action, <br />the officer is justified in the use of his weapon, If time doesn't per- <br />mit the officer to issue such an order then he is justified in using the <br />force necessary to save a human life, This justification shall be con- <br />strued to mean the saving of the officer's own life in a like situation, <br />C. MAJOR FELONIOUS CRZ•_:S AND THE FLEEING FELON: <br />1. An officer observing the cor=ission of a Felonious Crime and who <br />orders the suspect(s) to cease such criminal activity in a lawful <br />manner, after all other available means of prevention and apprehen- <br />sion have failed, is justified in the use of the firearm, If time <br />or circumstances do not permit the issuance of such an order, the <br />officer is justified in using the -weapon. to halt the criminal action, <br />2. An officer shall be deemed within the realm of right when using his <br />firearm to apprehend a Fleeing Felon under the following circumstances: <br />a. When an order to "Halt" has been given and the suspect has chosen <br />to ignore the command, <br />b. When all other available means of apprehension have failed, <br />C, When time and circumstance do not permit the order of "Halt" be <br />given, <br />D, WAn�NIING SHOT: <br />It is the Policy of the Redwood City Police Department that "No Warning <br />Shots be Fired." Deviation from this policy will be tolerated only when <br />extenuating circumstances prevail, <br />RULES AVS REGULAYIONS - Governing the use of deadly force - Firearms <br />E. STOLEN VEHICLE: <br />When a suspect has failed to heed all warnings given by an officer, such as <br />Red light and Siren, and appears to be definitely attempting to escape appre- <br />hension, the officer must still consider all circumstances prevailing before <br />using the firearm, i,e, the time of the day or night, location of the pursuit <br />as residential area or business area, open highway as opposed to city street, <br />and the safety of any and all persons in the area. If there appears even the <br />slightest possibility that injury to innocent bystanders could occur, then the <br />officer should choose another location to apprehend the suspect(s). After <br />consideration of the aforementioned facts the officer is justified in resorting <br />to the use of the firearm, <br />F. PROCEDURES FOLLMTING THE USE OF THE FIREARM: <br />1. In any case where the officer uses his firearm, a report in writing must <br />be submitted to the Chief.of Police explaining: <br />a, Time, Date and Location, <br />b: Type of incident which necessitated the use of the firearm: <br />C . Type of firearm used and the amount and calibre of the ammunition <br />expended, <br />d. All facts pertinent to the incident, <br />i <br />117 <br />
