PROVISIONS OF <br /> SECTION 35310 . 1 OF THE GOVERNMENT CODE , seconded by Councilman Henderson and carried <br /> on roll call vote . <br /> Mayor Bury introduced Mr . Frederick Badenoch , staff member of San Francisco Regional Office <br /> of the Department of Housing and Urban Development ( HUD) assigned to City for a month ' s <br /> training program under the League of California Cities arrangement with IUD for their <br /> Staff members to gain a better understanding of City governments . <br /> APPEAL of James and Anna Pomposo from denial by the Planning Commission of an application <br /> to relocate a property line between two parcels , 933 Eighth Avenue , being portion of <br /> Lot 8 , Block 7 , Friendly Acres , presented for consideration . <br /> Staff reported applicant had asked that the existing parcel be resubdivided to reduce <br /> the depth of one of the lots to 79 feet in order that the remaining property would <br /> include a temporary structure used as a garage , some fruit trees , fence , etc , , and <br /> that request was denied by the Planning Commission at their meeting of April 22 , 1969 . <br /> Mrs . Anna Pomposo appeared in her own behalf to urge <br /> Council ' s consent to subdivide their large parcel in <br /> a manner which would save the trees planted when they <br /> first acquired this property . They now desire to sell <br /> off a portion since their retirement , in effort to <br /> reduce taxes and maintenance . She stated parcel to be <br /> sold would still be in excess of 6 , 000 sq . ft . allow - <br /> able for a duplex if lot split allowed for 79 ' depth <br /> for parcel to be sold instead of 90 feet . <br /> After discussion of lot division requested , review of a map and exception which <br /> would have to be made in this instance , Council questioned the possibility of a <br /> future application for a lot split into three parcels , if this request is granted . <br /> After calculation , Planning Director advised lot area would be a little less than that <br /> required for a three lot division , but variance might be requested . City Attorney <br /> indicated sale of property could be conditioned on some type of legal arrangement <br /> between the two parties concerning trees . <br /> Councilman Keckley moved to affirm the action of the Planning Commission and deny the <br /> appeal , seconded by Councilman Arnett . It was suggested that property owner investi - <br /> gate the possibility of a property restriction when selling in order that trees might <br /> be protected in manner they desire .
