Motion carried , Councilman Arnett abstaining ( MINUTE ORDER <br /> /169- 11l ) <br /> PUBLIC HEARING , Application of GERALD FORREST to amend the Zoning Map to rezone property <br /> located at westerly corner of Uccelli Boulevard and Bair Island Road , being approximately <br /> 62 acres of unsubdivided land , from " TP " ( Tidal Plain ) District to " IR " ( industrial <br /> Restricted ) District , declared open and affidavits of publication and mailing ordered <br /> filed , <br /> Report of Planning Commission read in which it was stated after a public hearing held <br /> on May 13th , they had recommended Council approval for this requested rezoning . Staff <br /> report state the land proposed for rezoning is now vacant with frontage on a road <br /> having minimal standards ; that the owner of the property , operators of Allen Steel <br /> and Supply Company , with their operation in same general area , desire to expand the <br /> use to this site . <br /> It was also noted most of this area is in an undeveloped state , with only two other <br /> uses being in "TP " District , that of Redwood Drive - in Theatre and Pete ' s Harbor . <br /> Council questioned reason for the one -foot non-access strip around this parcel re - <br /> quested for rezoning . City Clerk reviewed formation of the three Bayshore Industrial <br /> Improvement Districts in 1961 and how one of the actions thereafter included authori - <br /> zation for an improvement agreement with PCA , then owner of this property , for City <br /> acceptance of the one foot non -access strip around the property in lieu of the usual <br /> subdivision bonds when property to be improved . The improvement agreement provides <br /> the non -access strip will not be released , assigned , conveyed , or otherwise transferred <br /> from land until streets and other improvements put in . <br /> Council questioned implications if rezoning approved before improvements made ; noted <br /> other adjacent areas being considered for similar rezoning by Planning Commission . <br /> City Manager advised City does own in fee the non -access strip along edge of this prop - <br /> erty , which would not permit access for use until roadway improvements made . Senior <br /> Planner advised a Use Permit would be required for usage proposed even if rezoning <br /> granted . In reply to question whether forming an improvement district had been <br /> discussed , Senior Planner advised property owner had indicated he would go along <br /> with improvements if such a district were established . <br /> Pete Uccelli , of Pete ' s Harbor , reported he had talked to <br /> Mr . Bean , owner of adjacent property , and of his willingness <br /> to also participate in development plans , but that he had no <br /> knowledge of attitude of other adjacent property owners . <br /> CouncilmanArnett suggested this zoning hearing be continued until other adjacent <br /> property ready for rezoning consideration and Staff be requested during this interim <br /> to prepare necessary documents to implement the formation of an improvement district . <br /> Other Council members concurred with desire for improvements to be made , but felt <br /> 'UN9le <br />
