<br /> SPECIFICATIONS FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS FOR REDWOOD CITY GENERAL
<br /> IMPROVEMENT DISTRICT NO , 1 -64 RELATING TO MARLIN SUBDIVISION NO . 3 ; AND AUTHORIZING
<br /> CITY CLERK TO CALL FOR BIDS THEREFOR , seconded by Councilman Arnett .
<br /> Staff report stated this subdivision is comprised of property fronting on Marlin
<br /> Court , Marlin Drive , and the Interior Waterway System , being a resubdivision of
<br /> lots in Marlin Subdivision No , 1 , and containing 83 lots to be developed under
<br /> a Planned Development Permit previously approved by Planning Commission and Council
<br /> for 83 single family attached townhouse type dwellings . It was also noted that
<br /> Leslie Properties , by a letter of intent on file , had agreed to participate in
<br /> the amount of $ 32_ , 654 , the estimated cost of construction of reclamation and
<br /> drainage work ,
<br /> City Manager stated he wished Council to be fully aware of fact that the Marlin
<br /> Subdivision No . 3 Final Map had not been recorded , but also this is not a pre -
<br /> requisite for calling for bids , He stressed again the great need to do all
<br /> possible , again commensurate with good judgment , and with assurance from City
<br /> Attorney as to propriety of proceedings with this action ,
<br /> Mr . Reiter , of DMJM , advised it was fully expected
<br /> that the Final Map for this Subdivision will be recorded
<br /> soon as merely a matter of mechanics , but it was felt to delay
<br /> action for calling for bids for these improvements would place
<br /> an unnecessary burden on the taxpayers in the District , He
<br /> also stated it was recognized this action would not be a commit -
<br /> ment for award of bids as schedule alone in calling for bids
<br /> and holding period allotted thereafter would give ample time
<br /> for Final Map to be recorded , but should some unforeseen cir -
<br /> cumstance arise and Map not be recorded , bids could be rejected .
<br /> He felt this action would prove to be good business judgment
<br /> without incurring any obligation for next step .
<br /> City Manager stated Final Map had been approved by Planning Commission and that he
<br /> had been advised by Director of Public Works that Map is technically correct . City
<br /> Attorney advised no legal problem existed for this proposed action as it was accept -
<br /> able to go to bid , recognizing that public property not acquired until Final Map
<br /> recorded , and if not , it would be simple enough for Council to rescind action pro -
<br /> posed and not make an award . Councilman Henderson opposed this proposed action as
<br /> being inappropriateetthis time , since Council had not as yet approved the Final
<br /> Map nor had a chance to review or inspect it at all , and not a wise action in view
<br /> of the serious questions recently raised at Congressional hearings . Motion carried
<br /> on roll call vote , Councilman Henderson voting no , Councilmen Keckley and Petersen
<br /> being noted absent .
