4 5 C P
City Manager in conclusion advised Staff would make every effort to participate
in meetings to be set by those concerned in this issue , and would keep Council
informed and also stated Staff had no reason to change their recommendation ;
based on opinion of Consultant that this project is not in any different status
._ now than when first commenced , and would recommend proceeding as usual with the
project .
Five minutes recess requested at 9 : 25 P . M .
PUBLIC HEARING , Resolution of Intention to abandon portion of public utility easement ,
Lot 20 , Block 2 , Farm Hill Estates #1 , declared open and affidavits of publication
and posting ordered filed .
City Clerk reported only communications on file were those of PG&E and PT&T
consenting to abandonment of this easement , provided wire clearance easements
retained .
City Manager advised that although these consents were on file , Mr . Borges , Manager
of PG&E , had contacted a member of Staff late today and asked that this matter
be held in abeyance , but since he stated no reasons for delaying action and as
applicants had waited for a long period , and wished to complete their project ,
he would recommend proceeding with action to abandon and that he would contact
Mr . Borges immediately, as felt there was merely a point of misunderstanding to
be corrected , as Mr . Borges himself had written communication stating PG&E
consent for abandonment . Director of Public Works concurred with recommendation
to proceed with this action and reported his own inspection in the field with
PG&E representatives would indicate no major problem exists . City Manager stated
applicants lived at 3863 Chatham Court , and needed to utilize portion of ease -
ment for their swimming pool project .
Mrs . Michael Cukrov , applicant , and owner of property
at 3863 Chatham Court , advised of large sized lot but full
of easements , all across rear and down side of lot , and
abandonment of portion of easement needed for installing
the pool equipment , as no place else to locate it and still
comply with City ' s codes . She advised of the agreement
with PG&E and her failure to understand why a delay asked
at this point , and delay would mean a hardshipo them
as completion of work long overdue and pool contractor
waiting to plaster and then fill .
After discussion as to whether Council action should be delayed in view of
present circumstances , or proceed since written consent had been given and
Staff would contact PG&E to resolve any misunderstanding , Councilman Henderson
moved to continue public hearing for one week and request Staff to convey dismay
of Council at the manner in which their request was made for continuance without
detailed explanation of reasons . Motion died for lack of a second .
Councilman Petersen moved to close the public hearing , seconded by Councilman
Rosselli and carried .
sEP .69
i it
