e <br /> t <br /> Emerald Branch ( Above County area , covering 2 portions on Alameda and comprising <br /> area bounded by Hillcrest , Oak Ridge Drive , along Canyon Road to Bradshaw Terrace - <br /> below County area and comprising area of Topaz , Sapphire , Ruby , and Quartz Streets . <br /> Director <br /> of Public Works advised no protests had been received for proposed improvements <br /> to creek improvements in area below the County area ( Exhibit 2B ) and only two lots <br /> in protest on creek improvements in area above the County area ( Exhibit 2 -A ) . In <br /> reply to question as to whether County planning any drainage improvements in un - <br /> incorporated area adjacent , Director of Public Works advised that County had been <br /> asked this question and that City was advised no funds were available for this <br /> purpose and they very strongly favored adjacent County area be annexed to the City <br /> so improvements might be included by the City . He also noted there had been residents <br /> of this County area at information Clinics , and indication had been given of their <br /> desire to annex to the City . He also was informed any drainage improvements in <br /> this unincorporated area would only be accomplished by County if property owners <br /> so desired and formed an assessment district for carrying costs . <br /> City Manager alEo noted a house was located over the creek in this County area which <br /> would cause more trouble for future creek improvements . He also reported full <br /> recommendation for improvements in this creek area not yet complete , but it was <br /> believed a channel would be necessary . <br /> In reply to question of whether City would be liable for any damage if creek im- <br /> proved upstream from County area , and flooding occurred downstream where no improve - <br /> ments made , City Attorney advised engineering design must accommodate the flow of <br /> water in the area , if the design produces a reasonable flow , then there would be <br /> no exposure to liability . <br /> Mark Reden , 951 Ruby Street , advised he had had no <br /> flooding troubles since a drain had been installed some <br /> fifteen years ago , but felt it to be of great advantage <br /> to have a good drainage system . <br /> Councilman Rosselli moved to instruct the Staff to proceed with preparation of <br /> plans and specifications for these two sections of the Emerald Branch , Exhibits 2A <br /> and 2B , seconded by Councilman Arnett and carried . ( MINUTE ORDER # 69 -211 ) <br /> Jefferson Branch ( comprising area bounded by Upton Street , Windsor Way , Alameda , <br /> Dover Road , Cheshire , Madison , Crompton Road ) <br /> Director of Public Works advised 18 property owners , or 52% , favored improvements <br /> to this area , 6 property owners indicating their disapproval , and no opinion having <br /> been received from remaining property owners . He noted those disapproving creek <br /> improvements did have nicely landscaped area . Councilman Henderson commented on <br /> her inspection of this area and agreed those indicating their disapproval had beautiful <br /> landscaping in the creek area and questioned feasibility of commencing improvements <br /> at street intersections and leaving creek alone in upper reaches of this area . <br /> Director of Public Works advised of problems which would be involved in maintenance <br /> unless easements were acquired through private property .
