2 '77 <br /> Mr . Ribera noted final drawing plans for the fencing <br /> would be commenced in preparation for getting plans <br /> ready for going out to bid after Council ' s final <br /> approval . <br /> PUBLIC HEARING , Application of HENRY ALBERS to amend the Zoning Map to rezone property <br /> located at 1122 Whipple Avenue , being Lots 20 , 22 , 24 and 26, Wellesley Park <br /> Subdivision No . 2 from "R-5 " ( Multi-Family High Density District ) to "R-5 ' T" <br /> ( Multi -Family High Density-Transient Residential Units Combing ) District , de - ' <br /> Glared open and affidavits of publication and mailing ordered filed . <br /> Planning Commission report read , in which it was noted their first action to deny <br /> this rezoning had failed to carry and action to grant the rezoning thereafter had <br /> carried by a six-to -one vote . There were no communications reported on file . <br /> Mr . Ralph Wood , of Wood and Associates , Oakland , representing <br /> Mr . Albers , the applicant , appeared and asked that he might <br /> describe from rendering the 164-bed convalescent hospital pro - <br /> posed for this site , if rezoning requested is approved , and <br /> Use Permit issued , <br /> In reply to Council question whether discussion of proposed use of the site in <br /> order when public hearing only involved rezoning at this point , City Attorney ad- <br /> vised discussion of proposed use was relevant to this public hearing . <br /> Mr . Wood advised their first application for this proposal <br /> had consisted of a request for a use permit but thereafter <br /> changed to the present rezoning request , inasmuch as the <br /> R-5 zoning would not permit such a proposal on this scale <br /> without the T-Combining District , and that such rezoning <br /> had been approved by the Planning Commission, and a Use Per- <br /> mit would still be required . <br /> He described from the rendering the three -story building <br /> proposed , no variances required , parking within the build- <br /> ing , etc . <br /> Council questioned definition of terms of this type of proposed facility , restric- <br /> tions of City ' s ordinance to 15-bed limitation relating to this type of proposal , <br /> and Staff report indicating their opposition to this particular site as not being <br /> appropriate for the proposed use for various specific reasons . <br /> Mr . Wood emphasized their supporting this location as a <br /> proper area because of its being on direct route to <br /> hospital area , close proximity to medical buildings in <br /> the area , and their proposed parking facilities of one <br /> space for every four beds exceeded requirements else - <br /> where in the Bay Area for this type of facility . <br /> City Attorney explained variation of the City ' s zoning ordinance in that the R-5 <br /> zoning provided for a nursing home of 15 -bed limitation as a conditional use only , <br /> whereas with T-Combining addition would permit as a conditional use the larger <br /> type of hospital home being proposed . <br /> In reply to questioning of Staff report indicating opposition to the proposal for <br /> this location, Planning Director advised Planning Commission recommendation of <br /> the rezoning now superseded Staff report although information contained therein <br /> not less valid . He also reviewed the research that had been made of the Bay Area <br /> for like developments as that proposed for specific standards as to parking, etc . <br /> In reply to questioning of control available as to lowering of intensity should <br /> this proposed development proceed to use permit consideration , Planning Director <br /> 119101:39 <br />
