306 <br /> Conference of a Commission member if it were not primarily concerned with finances . <br /> Councilman Henderson indicated agreement with views expressed as to responsibility <br /> of Council to determine financing matters , and felt it imperative that a Council <br /> member attend this Conference . She moved to deny request of Park and Recreation <br /> Commission for a Commission delegate to attend this Conference , seconded by <br /> Councilman Petersen and carried on roll call vote , Councilmen Henderson , Keckley <br /> and Petersen voting yes , Councilman Arnett and Mayor Bury voting no , Councilmen <br /> Rosselli and Weymouth being noted absent . ( MINUTE ORDER #69- 65 ) , <br /> Councilman Arnett related how , from past experience with Park and Recreation Com- <br /> mission , confusion existed on relationship of Commission to Council and wondered <br /> if a review of this situation might not be helpful , or even a joint meeting of <br /> Council with this Commission might clarify relationships . <br /> City Attorney , in response to question of Commission formations , advised of the <br /> establishment of Park and Recreation Commission by Code and the Planning Commission <br /> by Charter , and reviewed briefly how responsibilities defined . <br /> Mayor Bury noted that a request had also been received from the Park and Recreation <br /> Commission for an opportunity to appear before Council during Budget meeting , before <br /> Park and Recreation Budget finalized . Council consensus indicated budget considera- <br /> tions recommended through City Manager, and appearance by Commissions and Departments <br /> only if requested by Council . <br /> Legislative Committee Report <br /> Councilman Henderson , Chairman , reported proposed legislation had been reviewed by <br /> the Legislative Committee , with their recommendations as submitted to Council , <br /> summarized as follows : <br /> S .B . 310 would prohibit cities from requiring licenses and <br /> imposing fees with respect to cafe musicians , thereby ex- <br /> cluding a taxable item from local ordinances and resulting <br /> in a loss of revenue Committee recommends opposition , <br /> consistent with prior recommendations relating to similar <br /> legislation . <br /> S .B . 208 proposing to add a new section to the Labor Code to <br /> provide that heart trouble suffered by certain safety workers <br /> ( fire and police ) would be conclusively presumed to have <br /> arisen out of and in the course of their employment where <br /> serving ten years or more , thus providing industrial disability <br /> retirement and industrial death benefits , whether such con- <br /> ditions were job incurred or not . Committee recommends opposi - <br /> tion as appears to lack medical justification and represents <br /> piecemeal preferential treatment through procedural rules of <br /> evidence . <br /> A ,B . 325 proposing to restrict the acquisition of shares of <br /> corporations other than nonprofit corporations by certain <br /> public officials and employees ( including municipal officials ) <br /> and requiring disclosure of such investment and ownership of <br /> corporate shares . Committee recommends taking no position at <br /> the present time as subject matter under consideration by the <br /> Council ' s Ordinance Review Committee . <br /> A .B . 194 , 195 and 196 sponsored by the League of California <br /> Cities and proposing to permit cities to expend the motor <br /> vehicle license fees ( in lieu taxes ) and cigarette tax reven - <br /> ues for purposes broader in scope than now permitted . Com- <br /> mittee recommends support . <br /> S .B . 33 , S .B . 73 proposing change in apportionment of State <br /> Highway Fund construction money between northern and southern <br /> county groups and proposing such funds be allocated and ex- <br /> pended between the two groups in such amounts as California <br /> Highway Commission shall provide . Committee recommends op- <br /> position as both bills appear to have disadvantageous results <br /> for City and area . <br /> in14t9 <br />
