In response to a question from City Attorney Schricker, Mr. Hai advised
there will be no change in ownership or title.
CONSENSUS: Mayor La Berge determined it to be the consensus of the Council
to request Sam Bhas and Iftekhar Hai and Robert Post to do what is legally
right, to be "good neighbors ", and to make a good faith effort to assist the
tenants of the A -1 Motel in relocating.
MEMO 7/10/90
In response to Council questions, City Attorney Schricker, advised there is
nothing in Redwood City Municipal Code regarding demolition of buildings
that speaks to relocation of current tenants, but it is an area that might
be subject to the exercise of the police power.
Housing and Redevelopment Director Church, advised that the Housing and
Human Concerns Committee at their July 11th meeting would be discussing a
a draft ordinance requiring owner assistance in relocation.
Council advised the concept of owner assistance in relocation was discussed
during the General Plan process under the Housing Element over six months
ago and was referred to the Housing and Human Concerns Committee early
this year for further study and a recommendation to Council. There is a
history of Council interest and intent regarding owner assistance in
relocation. Also, Council discussed the desirability of considering the
recommendation of the Housing and Human Concerns Committee regarding the
draft ordinance requiring owners to assist in relocation, at the regular
Meeting of July 16, 1990.
Community Development Director Pawloski described the timetable for the
issuing of the demolition permit with a July 30 or August 6 target date.
When all conditions are met there is nothing to constrain the Building
Division from issuing the permit.
City Attorney Schricker advised that Housing Coordinator Debbi Jones - Thomas
has the legal right to assist in the relocation of the tenants of the A -1
Motel and any interference in the exercise of her duties under the
jurisdiction of the Housing Department would be viewed as interference with
a public act. It is of prime importance for the owners to work with Mrs.
Jones - Thomas in relocation efforts. In response to Council questions Mr.
Schricker explained the process for emergency ordinances, sunset clauses,
and the need for notification of the many other commercial owners affected
by such an ordinance.
CONSENSUS: Mayor La Berge
Council to direct staff to
assistance for relocation
of July 16, 1990.
determined it to be the consensus of the
prepare a draft ordinance regarding owner
to be presented to Council at the regular Meeting
MEMO 7/10/90
Reg.
