221 <br />COMMUNICATIONS: <br />Notification from Division of Highways that State Director <br />of Public Works had accepted the contract for landscaping <br />along Route 101 (Bayshore) between Marsh Road and Harbor Boulevard, <br />and requesting the City take appropriate action to notify <br />the responsible firms of the date removal of signs is to be <br />effected. <br />Selway Construction Company notification that they intend <br />to make claim for compensation and reimbursement concerning <br />conditions attached to their use permit granted for con- <br />struction of a service station at NW corner Woodside Road and <br />Hess, requiring widening and improvements of Woodside Road, <br />which they claim constitutes taking of private property for <br />public use without compensation as required by the Constitution. <br />Councilman Rosselli moved this matter be referred to the City Attorney for inves- <br />tigation, seconded by Councilman Henderson and carried. (MINUTE ORDER #66-151) <br />Councilman Bury expressed deep regret at the death of City Employee, Bill Shewry, <br />Assistant Park Superintendent, and asked that Council adjourn by adoption of <br />RESOLUTION N0, 5074 COMMEMORATING THE MEMORY OF BILL SHEWRY, seconded by Councilman <br />Granger and carried unanimously on roll call vote. M. <br />Meeting called to order at 7:30 P. M. by Mayor Herkner. <br />City Manager stated a detailed report had been submitted to Council concerning per- <br />sonnel recommendations for Council's action on the legislative meeting, but would <br />answer any questioning Council might still have on this subject, Councilman Hen- <br />derson asked whether Personnel Board had reviewed the job specifications proposed <br />and was advised by City Manager they had been reviewed and approved, <br />Councilman Granger asked that provision be added in proposed referendum and recall <br />ordinance to require circulators of petitions to make application to City Clerk and <br />take the loyalty oath. City Attorney advised general procedure on circulation of <br />petition for referendum or recall was established by General Law and our City Charter <br />states General Law shall be applicable. Additionally, the Charter states Council shall <br />designate three depositories where petitions might be circulated or deposited. He <br />further stated ordinance as prepared basically sets forth the procedures following <br />Charter provisions as Council had never taken any action establishing such procedures, <br />City Attorney also advised of the Petition for Writ of Mandate that had been filed <br />against the City Clerk on the Napalm issue, and that an answer would be filed by his <br />office. <br />Councilman Keckley questioned the high costs quoted for increased coverage on Employees' <br />Faithful Performance/Honesty Bonds, and reasons for this recommendation, City Manager <br />advised this recommendation for increased coverage was Staff's request for further <br />protection to City in view of fact general growth of City in all fiscal matters since <br />original bond amounts set.
