275 <br />Council was advised all documents in evidence at public hearing before Planning <br />Commission, including document in question, were to be considered in evidence before <br />the Council at this public hearing. The following appeared: <br />Charles Chandler, partner in Challstrom Builder's Inc., outlined <br />points on which they based their contention this parcel should <br />be rezoned to R-2 from economic standpoint, unsuitability for <br />R-1 single family residences of this quality in view of adjacent <br />uses, requested zoning more suitable for buffer zoning to adjacent <br />R-1 proposed planning less hazardous to present traffic flow on <br />Jefferson with fewer driveways than if planned for single family <br />residences. (For full context of Appellant's appeal see Clerk's <br />File -Planning Commission - Rezoning) <br />Walter Krutman, 3570 Jefferson Avenue, protesting rezoning this <br />parcel to R-2. Also presented telegram addressed to himself from <br />R. B. Kilgallen, 3602 Jefferson, containing protest of R-2 rezoning <br />of this parcel. <br />Herbert Stone, 3571 Altamont Way, favored R-2 as good bufer from <br />his own R-1 zoning. <br />Hans Jehle, 851 Piedmont, favored zoning remain R-1. <br />Joe Tanouye, 843 Piedmont Way, favored zoning remaining R-1, and <br />questioned validity of names on petition favoring rezoning, sub, <br />mitted by appellants. <br />Albert Bianchini, 3616 Jefferson Avenue, protested R-2 zoning <br />because of further complicating parking problems in this area. <br />Mrs. Henry Crossfield, 3561 Altamont, opposing R-2 zoning and <br />advised she had not signed petition favoring rezoning although <br />her name appeared on the petition. <br />Mrs. Joe Tanouye, 843 Piedmont, protesting change of zoning. <br />Councilman Petersen questioned representation made concerning invalidity of <br />names on petition submitted into evidence. <br />Jim Chandler, of Challstrom Builders, explained some names appear- <br />ing on petition had been contacted, and comment noted thereafter, <br />with no allegation made that they had signed petition. <br />Councilman Bury moved to close the public hearing. Further questioning by Council <br />members as to proposed development, undergrounding of utilities, and points covered <br />during public hearing before Planning Commission, parking restrictions of area, etc., <br />Motion to close public hearing seconded by Councilman Petersen and carried. <br />Councilman Bury after commenting on his reasons for opposing rezoning moved to affirm <br />the action of the Planning Commission and deny the appeal, seconded by Councilman <br />Rosselli. On question Councilmen Petersen and Councilman Keckley expressed their <br />opinions as to why rezoning should be considered in view of property having stood <br />vacant for so long and economic reason as to development and also because driveway <br />combinations proposed would reduce traffic problem on this heavy traveled street. <br />Councilman Rosselli felt Council should retain R-1 zoning. <br />Councilman Henderson favored lessening of driveway approaches on Jefferson but <br />expressed concern and doubt as to change of zoning. Motion to affirm action of <br />Planning Commission and deny appeal lost on roll call vote, Councilmen Bury, <br />Rosselli voting yes, Councilmen Granger, Henderson, Keckley, Petersen and Mayor <br />Herkner voting no. <br />City Attorney advised if Council desired to consider action to rezone this parcel, an <br />ordinance had been prepared. <br />
