365 <br />Minutes of Regular Weekly Study Meeting <br />Redwood City Council <br />November 28, 1966 7:30 P. M. <br />Meeting called to order by Mayor Herkner at 7:30 P. M. <br />Grading Ordinance. Councilman Rosselli stated introduction of this Ordinance had <br />been purposely held over in order Staff might again review it and make a further <br />recommendation concerning its need for adoption, as he had stated he concern over <br />costs of publication if Ordinance not going to serve a need. City Manager stated <br />further meetings had been held with those interested, in particular with Mr. Fred <br />Gates, as directed by Council, and suggestions for changes had been of a minor <br />nature, which Staff had no objection to incorporating in the proposed Ordinance. <br />City Manager proceeded to briefly review changes suggested, Staff's main concern <br />still being effect to individuals doing a small amount of excavation work, but <br />advised final draft would be presented at Council meeting of December 5th. Mayor <br />Herkner requested that a listing be made of questions and points of concern which <br />had been submitted in order Council might check changes. (Memo 11/29/66) <br />Councilman Rosselli questioned inference that Peninsula General Contractors Asso- <br />ciation was opposed to proposed ordinance as he understood otherwise. <br />City Manager advised organization did not specifically favor ordinance per se, but <br />if ordinance felt necessary, the drafted ordinance was acceptable. Councilman Bury <br />questioned whether purpose of this ordinance to control massive types of earth <br />movement could not be accomplished by a less restrictive ordinance that would not <br />disturb individual small cases, such as one lot. City Manager advised Staff had <br />reviewed both Subdivision Ordinance and Zoning Ordinance with thought of amendments <br />which might effect control desired, but it appeared control could not be accomplished <br />if sections added to these two ordinances. City Attorney also commented on lack of <br />control should provisions for restriction of earth movement be inserted in Subdivision <br />Ordinance as this would only affect areas where a Subdivision was coming into existence <br />and cited example such as Motorcycle Hill should it not be developed as a subdivision, <br />no control would be possible for earth movements. <br />Councilman Bury asked whether minimum amount of earth movement proposed could be <br />raised. Councilman Henderson questioned whether it would be possible to include a <br />waiver of control as to any small individual or borderline operation for earth <br />movement. City Attorney advised only provision having effect of a waiver related to <br />some of standards, but could be changed in this respect. He also warned on points of <br />liability of City once it assumed regulatory powers. Councilman Petersen commented <br />on various points concerning restrictions on small property owner, and suggested ordinance <br />be made available to all interested for further discussion and this be placed on Council <br />Agenda for next week. <br />Mr. Fred Gates indicated his desire for copy of proposed <br />ordinance including all section changes indicated by <br />City Manager. <br />
