367
Councilman Petersen asked whether slough depicted on illustrated map of area was
navigable and was advised it was filled to a certain degree and it was not known
for certain if under jurisdiction of BCDC or not. It was stated that slough in-
dicated on map not physically apparent except on aerial photos showing depression
of area.
Councilman Petersen moved to close the public hearing, seconded by Councilman
Bury. Motion carried. Councilman Henderson asked whether this annexation will
pay on bonds already issued, and was advised by City Attorney annexation subject
to taxation for all district bonds now outstanding and authorized, etc., to
same extent as if land had been included in the district when established.
Councilman Rosselli moved to adopt RESOLUTION NO. 5206 ANNEXING LANDS TO GENERAL
IMPROVEMENT DISTRICT NO. 1-64 OF THE CITY OF REDWOOD CITY, seconded by Councilman
Bury and carried on roll call vote.
Councilman Petersen moved to adopt RESOLUTION NO. 5207 GRANTING EXTENSION OF TIME FOR
COMPLETION OF UNDERGROUNDING OF UTILITIES IN UNDERGROUND UTILITY DISTRICT NO.
66-1, seconded by Councilman Keckley. Staff reported shortages of materials had
delayed the completion of this District beyond the 200 days specified in Ordinance
No. 1237, and extension recommended would provide for completion in Febrary, 1967,
a total of 100 days additional, making total days for completion 300 days. Motion
carried on roll call vote.
Application of Morris Rudick, dba Kuhn Jewelers, for extension of time for Close Out
Sale, presented, having been carried over to this meeting for full Council to
be present.
Councilman Petersen moved to grant extension of 30 days as requested, seconded
by Councilman Henderson.
Sidney Berlin, Attorney representing Mr. Rudick, reviewed
history of this business operation and since its purchase
by Mr. Rudick. He further reviewed circumstances making
closing of business operation necessary, the granting of
the closing out sale permit and urged that extension be
granted for continuance of closing our sale.
Councilman Granger and Keckley questioned details as to original application made
by Mr. Rudick and dates of permit as granted by Council previously for closing
out sale. City Clerk advised request was for permit commencing 10/27/66 for
thirty days, terminating December 1st. Councilman Petersen favored extension of
closing out sale. Councilman Rosselli indicated his not favoring continuance of
closing out sale during December in fairness to other merchants and felt business
could be conducted as regular sale during December and closing out sale permit be
again granted thereafter.
Councilman Keckley questioned points of ordinance covering closing out sales. City
Attorney advised Ordinance regulates method of advertising only, and it was
possible to continue in business after permit expires if advertising curtailed and
precluded reference to closing out sale. Motion to grant extension for 30 days
lost on roll call vote, Councilmen Henderson and Petersen voting yes, Councilmen
Bury, Granger, Keckley, Rosselli and Mayor Herkner voting no.
