X68 <br />Councilman Petersen moved to grant extension for a fifteen day period, to <br />December 15th, seconded by Councilman Henderson, if acceptable to applicant. <br />Councilman Rosselli moved to amend motion made by terminating closing out sale <br />period for thirty days and then grant permit again at end of this period, or <br />effective January 1st. No second to amendment. <br />Councilman Keckley asked maker of original motion if he would substitute 10 days <br />instead of 15 days, terminating sale on December 10th. Councilman Petersen <br />countered with a request for a full 2 weeks extension. Councilman Bury suggested <br />a substitute motion granting sale permit to start January lst for thirty days. <br />Original motion to grant extension for 15 days lost on roll call vote, Councilmen <br />Henderson, Petersen and Mayor Herkner voting yes, Councilmen Bury, Granger, <br />Keckley and Rosselli voting no. <br />Councilman Rosselli moved to grant extension of closing out sale for a 30 -day <br />period commencing on January 1st, 1967, seconded by Councilman Bury. Councilman <br />Petersen moved to table motion, seconded by Councilman Henderson and lost on <br />roll call vote, Councilmen Henderson, Keckley, Petersen, voting yes, Councilmen <br />Bury, Granger, Rosselli and Mayor Herkner voting no. <br />City Attorney was questioned as to sale procedures which would be possible <br />during December in event closing out sale permit granted commencing January lst, <br />1967. City Attorney warned it would not prevent additional stock being acquired <br />during this period so long as it was not in evidence during closing out sale period <br />contemplated for January. Councilman Henderson expressed views on Ordinance <br />concerning this type of sale and need for clarification. Councilman Keckley urged <br />Council not allow continuance of regular sale during Christmas period. <br />Motion to grant extension of closing out sale permit, commencing on January <br />1st, 1967 lost on roll call vote, Councilmen Bury and Rosselli voting yes, <br />Councilmen Granger, Henderson, Keckley, Petersen and Mayor Herkner voting no. <br />Councilman Keckley moved to grant extension of ten days to present permit, ter- <br />minating December 10th. No second to motion. Councilman Henderson moved to grant <br />extension of two weeks, seconded by Councilman Petersen and lost on roll call <br />vote, Councilmen Henderson, Petersen, and Mayor Herkner voting yes, Councilmen <br />Bury, Granger, Keckley and Rosselli voting no. <br />Councilman Keckley remade motion that present closing out sale permit be extended <br />to December 10, 1966, seconded by Councilman Henderson and carried on roll call <br />vote, Councilmen Bury, Henderson, Keckley and Mayor Herkner voting yes, Council- <br />men Granger, Petersen and Rosselli voting no. (MINUTE ORDER #66-142) Councilman <br />Bury stated his affirmative vote was based on the business terminating at the <br />close of the sale period. <br />Mr. Berlin advised his client would endeavor to close <br />his business on the 10th of December and thanked Council <br />for their consideration on this matter. <br />
