379 <br />PUBLIC HEARING, Application of HARKER DEVELOPMENT, CORP. FOR amendment to the Zoning <br />Map to rezone three land segments, bounded by Broadway, Woodside Expressway, <br />Bay Road, and the Southern Pacific Railroad spur, from IP to IP -A, IP -T -A, and <br />IR -A, declared open and affidavits of publication and mailing ordered filed. <br />Report of Planning Commission read recommending that the property be rezoned as <br />follows: 22,800 sq. ft., at the corner of Broadway and Woodside Expressway from <br />IP to IP -A; 68,200 sq, ft, at Woodside Expressway and Bay Road from IP -IP -T -A; <br />and denial of the application to rezone 15,500 sq, ft. facing Broadway, from <br />IP to IR -A, motion being amended to include a statement of intent by the Planning <br />Commission that rezoning proceedings on this portion for IR -A will be initiated <br />after construction of amotel and restaurant is significantly underway. Staff <br />report read in which traffic study indicated no conflicting problem would exist <br />to uses proposed at this site. <br />H: B. Grabow, Bay Area representative for Harker Develop- <br />ment Company, applicant in this request for rezoning, <br />stated their plan for development of three parcels into <br />a motel, restaurant, service station, complex which they <br />deemed to be most economically feasible, similar to the <br />approved "Motel 6" complex, and which would be compatible <br />to this site and create no traffic problems. <br />Councilman Petersen questioned whether motel and restaurant development would <br />be initiated if rezoning to accommodate service station denied pending 40% <br />completion of first two developments, and questioned City Attorney if such action <br />possible. <br />Mr. Grabow stated financing difficulties which would be <br />faced for construction of motel only at this time, and <br />need for 3 zonings requested at one time. <br />City Attorney advised statement of intent could be made by Council but not binding, <br />Councilman Rosselli expressed concern over number of service stations and need <br />for assurance total proposed development would be completed. <br />Mr. McKeever, of Mobil Oil Company, stated their company <br />would not be interested in this site as a service station <br />alone, and would want to be guaranteed some other develop- <br />ment would go on the property. <br />City Attorney questioned as to procedures in view of appeal made on one segment <br />of this parcel and to be subject of next public hearing. He also advised Use Per- <br />mit must be obtained for service station, even if requested zoning is granted. <br />Mr. Grabow advised their Company couldn't purchase pro- <br />perty if all that was intended was construction of ser- <br />vice station as it would not be feasible economically. <br />Councilman Granger questioned Planning Commission's reasons for not granting <br />rezoning for all of parcel as requested. <br />William Oeser, member of Planning Commission and present <br />in audience, statedhis personal opposition to adding to <br />number of service stations already on this one artery. <br />Councilman Henderson questioned other proposed developments which included service <br />stations referred to by applicant, and if zoning appropriate for their inclusion. <br />City Manager stated he felt ultimate plan of Howard Johnson's development at <br />Veterans and Bayshore did include a service station. <br />
