24 <br />a minimi=average lot width of 25 ft. instead of the required 35 ft.; and side <br />yards of 4 ft. where 6 ft. and 10 ft. are required, in an R-4 District, at 105 <br />Redwood Avenue, being Lot 14, Block 1, Reese Subdivision, declared open and <br />affidavits of publication and mailing ordered filed. <br />Planning Commission report read in which it was reported, after a public hearing <br />held on March 28, 1967, Commission denied the variance application by a motion of <br />4 to 2 (1 absentee). Staff analysis previously submitted to Rouncil reviewed <br />facts of this property having been denied a similar variance on July 19, 1965. <br />Communication read from: <br />Frank Rodriguez, 119 Redwood Ave., protesting granting <br />of the variance requested for permit to build a single <br />family dwelling on this lot. <br />John F. Mylod, Attorney representing Mr. Boudreau, <br />reviewed points of his client's purchase of this property <br />from the State when present regulations for building on <br />this size lot were not as restrictive, although aware he <br />would be subject to a variance proceeding. He stated <br />he also was aware of the fact the City had advised the State against <br />selling this parcel, but that Mr. Boudreau had no such <br />information at time of his acquiring same. <br />He advised of the attempts made by Mr. Boudreau to buy <br />the property adjacent to his lot and attempts to sell <br />property, even to the City. He outlined predicament of <br />his client under the circumstances presented with his <br />continuing taxes, and urged Council's consideration of <br />granting variance to allow single family dwelling instead <br />of remaining a vacant lot "eyesore". <br />He submitted pictures of other dwellings which had been <br />constructed on 25' lots and felt if this matter could be <br />referred to the Architectural Committee, plans could be <br />submitted for a dwelling which could be approved. <br />Councilman Granger questioned possibility of this matter being referred to the <br />Architectural Committee for an investigation and report back. Councilman Hen- <br />derson, in view of questioning previous hearings on this matter and noting the <br />two denials by the Planning Commission and one denial by the Council, stated <br />she was sympathetic to unfortunate circumstances, but felt this should be <br />worked out with the State by Mr. Boudreau. <br />Councilman Petersen suggested possibility of Staff trying to aid Mr. Boudreau in <br />his attempt to get this problem resolved through the State for a refund of his <br />money and a gift made of this Wcel to the City. City Manager stated Staff would <br />make the contact to the State, if requested by Council, but felt in all proba- <br />bility that State would advise sale had been adequately noticed and bought "as is" <br />and expressed his extreme doubt of any refund being likely for lands purchased <br />at public auction. Councilman Keckley recalled this type of recommendation had <br />been made by Planning Commission that State be contacted to see if some relief <br />was possible and that it was also brought out that State had been notified by <br />the City prior to this sale that this was not a buildable lot and urged sale not <br />be made, but that price of lot was raised during bidding procedures from that <br />set by State. Councilman Keckley questiones safety factor of a driveway at this <br />site, should variance be granted, as believed it was strongly recommended <br />against by Traffic Engineer for presenting a hazard with traffic on Redwood <br />Avenue. <br />APR 17 '07 <br />
