Councilman Rosselli stated he still felt house should have been moved prior to <br />this time to take the pressure off of the slide area, even if the house had to be <br />moved onto another empty lot. Councilman Henderson moved to accept Staff recommen- <br />dation and grant the extension for Sixty (60) days, seconded by Councilman Keckley. <br />Councilman Bury stated he felt a performance bond should be required to insure <br />compliance with conditions of this house moving. <br />City Attorney advised this was a provision of the present Ordinance for protection <br />of City streets, but that a bond could also be required where it was felt necessary <br />to insure compliance. City Manager stated a $5,000 performance bond had been <br />requested in this instance. <br />Councilman Petersen questioned further details concerning the performance bond. <br />City Attorney advised a bond normally set to support an agreement, but if defaulted <br />in this instance, City would not get the amount of bond refunded, but only damage <br />which resulted, and in this instance, no damage could be claimed at this point. <br />City Attorney also stated the house could still be requested to be removed by the <br />existing permit and extend period for completion of remodeling. City Manager <br />indicated his approval of City Attorney's recommendation that would require moving <br />of the house on existing permit by May 27th and extension of time be granted for <br />60 days to put the house in an approved habitable condition on the new site. <br />Paul Tessendorff questioned ownership of lands on the <br />slide area and stated he felt a fence should be placed <br />on the site. <br />Councilman Bury suggested it might be well to consider a forfeiture penalty in future <br />house moving actions. After further discussion and intent of Council's action <br />in granting the extension after recommendations made, Councilman Henderson <br />restated her motion to grant the sixty (60) day extension for reconstruction of <br />the house, subject to the house being moved before the expiration of the present <br />house moving permit, May 27th. Restatement of the motion accepted by the Second <br />of the motion and carried on roll call vote, Councilman Rosselli voting no. <br />(MINUTE ORDER #67-94) <br />Councilman Keckley moved to adopt RESOLUTION NO. 5364 ACCEPTANCE OF REVOCABLE PERMIT FROM <br />SAN FRANCISCO WATER DEPARTMENT IN CONNECTION WITH CREEK CHANNEL IMPROVEMENTS FOR <br />GENERAL IMPROVEMENT DISTRCCT 1-65, PROJECTS SD -11 AND SD -12, seconded by Councilman <br />Bury. <br />Staff report stated these rights-of-way are needed in connection with Projects <br />SD -11 and SD -12, GID 1-65, where the creek improvements will cross the Hetch- <br />Hetchy rights-of-way in the vicinity of the intersections of Redwood Avenue and <br />Ebener Street, and Vera Avenue and Dickey Street. Motion carried on roll call <br />vote. <br />Councilman Petersen moved to adopt ORDINANCE NO. 1312 AMENDING SECTION 25.8 OF, AND <br />REPEALING SECTIONS 25.9, 25.10 AND 25.12 OF THE CODE OF THE CITY OF REDWOOD CITY <br />RELATING TO MEETINGS OF THE PARK AND RECREATION COMMISSION (authorizes changing <br />of Commission's meeting location from Veterans Memorial Building to Community <br />Activities Building) seconded by Councilman Rosselli and carried on roll call vote. <br />COMMUNICATIONS: <br />Park & Recreation Commission communication reporting action <br />taken by their Commission that Redwood City adopt the "red <br />rose" as the official flower of the City. <br />71 <br />WAS '8i <br />
