80 <br />Councilman Granger asked, for the benefit of the record, that Staff advise <br />whether plans and specifications for this construction had been approved by the <br />City Manager. City Manager advised a written recommendation is on file by Jenks <br />& Adamson and Director of Public Works, and which recommendations were concurred <br />in by himself. - <br />Councilman Rosselli stated it had been some three years since discussion had been <br />held concerning the elimination of dead end streets in this area, and asked whether <br />this had been given any further consideration by Staff as any observation of this <br />situation clearly revealed the need for relief of this situation. Mayor Herkner <br />asked that City Manager check on this and report to Council. (Memo 6/23/67) <br />Councilman Petersen felt it noteworthy to comment on the very favorable bids <br />received on this project, stating there was low bidding under the Engineer's <br />estimate. Motion carried on roll call vote. <br />Appeal of Larry Schwab from denial by the Planning Commission of his application for <br />a Use Permit to allow the construction of a duplex, in a "CP" District, at 101 <br />Laurel Street, being a portion of Lot 6, Block 24, Eastern Addition, presented <br />for consideration. <br />Report of the Planning Commission was read in which it was stated Commission had <br />voted unanimously to deny this application for a Use Permit, and that a public <br />hearing had not been held. Staff report was read in which a review was made <br />of the area, the substandard lot which had been purchased by auction from the <br />State as surplus after construction of the Woodside Overpass, the former request <br />made by Mr. Schwab for a Use Permit to allow construction of a four -unit apart- <br />ment on this same lot and also denied by the Planning Commission, the present <br />zoning being for commercial and industrial uses although basically residential <br />at this time, with recommendation made by Staff that application be denied. <br />Mr. Schwab appeared in his own behalf to urge Council's <br />consideration for granting his appeal for construction <br />of an attractive duplex dwelling on this lot which would <br />upgrade the neighborhood. He stated at the suggestion <br />of Planning Staff, he had attempted to acquire additional <br />adjacent property, but was unable to do so, and inasmuch <br />as commercial development of the area under the present <br />commercial zoning would be some time in the future, he felt <br />duplex he requested could be converted to a commercial <br />office use when it was opportune. <br />Planning Director reported Planning Commission action had been unanimous in <br />denying this application for two main reasons: <br />(1) Planning Commission determined not to create or per- <br />petuate a substandard situation as in this CP area even <br />though predominantly residential single family dwellings <br />at this time, while applicant's proposal would be to con- <br />struct to a higher density; <br />(2) Zoning Ordinance does not allow issuance of a Use Permit <br />on any lot in a CP District under 10,000 sq. ft., this <br />lot being much less, all of which would not be in the best <br />interests of the City to invite a substandard development <br />to occur. <br />Councilman Granger questioned Planning Commission's attitude further as to trying <br />to maintain conditions now existing or trying to upgrade.
