100 <br />Councilman Granger moved to adopt RESOLUTION NO. 5376 AWARDING CONTRACT FOR CON- <br />STRUCTION OF THE SIGNALIZATION, CHANNELIZATION, AND LIGHTING FOR VETERANS BOULE- <br />VARD, 150 FEET EAST OF MAIN STREET TO MIDDLEFIELD ROAD AND FOR THE IMPROVEMENT <br />OF BRADFORD STREET, MAIN STREET TO JEFFERSON AVENUE; REJECTING ALL OTHER BIDS <br />RECEIVED; AUTHORIZING EXECUTION OF CONTRACT FOR SAID WORK; AND, DIRECTING RETURN <br />OF SECURITY DEPOSITS, seconded by Councilman Petersen. <br />Councilman Granger questioned recommendation on record for proceeding with this <br />proposed construction. City Manager advised three signatures on record recommen- <br />ding the award from Glenn Jain, Deputy Director of Public Works, J. Louis Scherer, <br />Director of Public Works, and by himself as City Manager. Councilman Henderson <br />quewtioned funding proposed for project and was advised funds available in the <br />current budget from gas tax and sales tax funds. Councilman Bury questioned any <br />possible conflict with proposal for gas station improvement in this vicinity and <br />was advised there was no conflict. Motion carried on roll call vote. <br />REPORT OF BID OPENING, Project SD -4, GID 1-65, Redwood Creek Channel Improvements, <br />E1 Camino to Middlefield. The following bids were received: <br />Chaides Construction Co. $91.167.00 <br />A. E. Mullin 110,632.00 <br />Power Const., Inc. 121,244.00 <br />Geo. Bianchi Const. Co. 123,960.00 <br />McGuire & Hester 137,810.00 <br />Engineer's Estimate $117,682.00 <br />City Clerk read communication from apparent low bidder for this project, Chaides <br />Construction Company, Inc., in which they asked that they be allowed to withdraw <br />their bid because of an error in computation due to last minute rush in assembling <br />their bid. Communication also read from Director of Public Works to the City <br />Manager informing him of the notification received after bid opening from Chaides <br />Construction Company of their discovery of error in their submitted bid and of the <br />review of bid which was made by Jenks & Adamson with the, which indicated error <br />amounted to about $17,000, and of the subsequent letter from this Company request- <br />ing permission to withdraw their bid. <br />He further stated that a check of the bids would indicate a $17,000 error in <br />this bid was a definite possibility because of its relationship to next two <br />lower bids. He also advised of the research made by City Attorney citing a <br />similar case in which the Court had ruled in favor of the Company involved. <br />Director of Public Works recommended that the Council allow the Chaides Construc- <br />tion Company to withdraw their bid and accept the bid of A.E. Mullin Construction <br />Company in the amount of $110,632.00 and it was also stated this Company had <br />indicated their desire to accept the Contract if Council allowed Chaides Construc- <br />tion Company bid to be withdrawn and City Manager concurred in recommendation. <br />Councilman Petersen moved to adopt RESOLUTION NO. 5377 AWARDING CONTRACT FOR CON- <br />STRUCTION OF REDWOOD CREEK CHANNEL IMPROVEMENTS, EL CAMINO REAL TO MIDDLEFIELD <br />ROAD, GENERAL IMPROVEMENT DISTRICT 1-65, PROJECT SD -4; CANCELLING APPARENT LOW <br />BID; REJECTING ALL OTHER BIDS RECEIVED; AUTHORIZING EXTENSION OF CONTRACT FOR <br />SAID WORK; AND DIRECTING RETURN OF ALL SECURITY DEPOSITS, seconded by Councilman <br />Henderson. <br />Councilman Granger questioned whether City Manager's recommendation was con- <br />curred with by the City Attorney.
