172 <br />City Attorney suggested Councilmight possibly take action at this hearing on <br />written protests which had been received and reviewed by Staff, oral protests be <br />received thereafter from others, and public hearing continued in order Staff might <br />review these oral protests, and make their summarization and recommendation to <br />Council. He also advised the Council was sitting as a Board of Equalization in this <br />instance inasmuch as Council had to make a conclusive decision of assessment charges <br />in order they might be coded on the Assessment Roll. <br />After further Council discussion as to advisibility of taking action on Staff's <br />recommendation after review of written protests on file, or continuing public <br />hearing in order to allow more time for negotiation between protestants and Staff, <br />Councilman Granger moved to continue public hearing for one week and all protests <br />be returned to Street Superintendent for a further report, seconded by Councilman <br />Bury. Councilman Petersen favored accepting recommendation of Staff on those <br />protests which had been previously reviewed. Councilman Bury favored continuance <br />because of importance of this matter and in the hopes a full Council might be <br />present. Motion to continue hearing to August 14th tied on roll call vote, <br />Councilmen Bury and Granger voting yes, Councilmen Petersen and Mayor Herkner <br />voting no. <br />Mayor Herkner ruled motion lost for lack of a majority and asked that Council <br />proceed with conclusive actions on protests presented. Councilman Granger moved <br />to cancel weed abatement charges for <br />Mrs. Mary Lipovac <br />1062 -17th Avenue <br />Parcel #055-222-060 <br />in the amount of $42.00, because of evidence presented through cancelled checks <br />submitted that weed abatement had been done by a private contractor. Motion <br />lost for lack of a second. <br />After further discussion, Councilman Bury moved that this protest bereferred <br />back to Staff for a further review and comparison of protestant's receipts for <br />abatement work done privately with dates of City's abatement schedule on this <br />property, and a report be made to Council, seconded by Councilman Petersen. <br />Councilman Granger requested that an affidavit be submitted by this protestant <br />from her private contractor stating the payment received was for abatement of <br />weeds. Motion carried. (MINUTE ORDER #67-164) <br />Mr. Alfred McKelvey Parcel #052-383-100 $515.20 <br />48 Lloyden Dr. if 052-383-130 374.12 <br />Atherton Total Assessment charges $ 8- 9,31} <br />Mr. McKelvey appeared representing property owned by McKelvey - <br />Ely Land Co. and McKelvey & Lazzarini Investment Corp. in the <br />Motor City Subdivision Development area, property formerly known <br />as the "rodeo grounds". <br />He protested charges proposed for weed abatement because of this <br />area having been under filling and compaction for the past year <br />for the new Motor City development now under construction. He <br />compared costs paid privately for weed abatement during the <br />previous year in the amount of $1,056.00 covering whole of 32 <br />acres, while charges proposed this year covering only 14 acres <br />indicated a charge of $889.34. <br />
