194 <br />Councilman Rosselli moved to reduce assessment charges by 1/3, <br />seconded by Councilman Granger. Council questioned motion as to <br />intent in reducing such charges and how costs to be computed. Mo- <br />tion tied on roll call vote, Councilmen Granger, Rosselli and Mayor <br />Herkner voting yes, Councilmen Bury, Keckley and Petersen voting no. <br />Councilman Petersen moved to deny the protest and confirm the assess- <br />ment charges, seconded by Councilman Keckley on basis of statement <br />made that abatement work had been done and protest based on fact some -- <br />weeds still present. Motion tied on roll call vote, Councilmen Bury, <br />Keckley and Petersen voting yes, Councilmen Granger & Mayor Herkner <br />voting no. <br />Discussion held concerning effect of tied motion. Assistant City <br />Attorney advising motion in this instance would constitute in effect <br />a cancellation of the entire assessment charges. <br />Councilman Keckley moved to reduce the assessment charges by 1/3 on <br />this property, provided Mr. Boicelli and City could stipulate that no <br />further weed abatement work would be done on this property this year, <br />and City not be held responsible for weeds now claimed present, <br />seconded by Councilman Granger. <br />Assistant City Attorney advised motion proposed not possible because <br />of facts of contract commitment to pay charges for all parcels <br />assessed, and motions possible for Council action again stated as can- <br />cellation, modification, or confirmation of charges. After further dis- <br />cussion, motion withdrawn. <br />Councilman Bury moved to deny the protest and confirm the assessment <br />charges, seconded by Councilman Petersen and tied on roll call vote, <br />Councilmen Bury, Keckley and Petersen voting yes, Councilmen Granger, <br />Rosselli and Mayor Herkner voting no. <br />Councilman Rosselli moved to table this matter. Motion died for lack <br />of a second. <br />Further discussion held as to other similar actions taken by Council in <br />denying protests where abatement work had been performed according to <br />protestants, and questioning as to why this should be questioned and <br />favored for denial, Mayor Herkner indicated his opposing charges in <br />this matter because of Mr. Boicelli advising he would perform weed <br />abatement work himself the previous year, but he realized from dis- <br />cussion of present ordinance requirements, that a written notice to <br />the Department of Public Works was required each year. <br />Councilman Keckley again moved to deny the protest and confirm the assess- <br />ment charges, seconded by Councilman Bury if it was the intent that all <br />such actions taken would not preclude possibility of a protest still being <br />reviewed, even after confirmation on Tax Roll, as done in other years. <br />Motion carried on roll call vote, Councilmen Bury, Keckley, Petersen, <br />and Mayor Herkner voting yes, Councilmen Granger and Rosselli voting no. <br />ASSESSMENT CONFIRMED <br />Consideration of assessment charges recommended for cancellation by Staff, <br />after review, as follows: <br />Louis & Janet Neubauer, 1021 Marsh Road <br />Parcel 055-222-280 $5.60 <br />Lee & Faye Colby, 1017 Marsh Road <br />Parcel 055-222-290 $5.60 <br />Louis & Mary Dallara, 142 Oakwood Dr. <br />Parcel 059-133-070 $4.62 <br />ASSESSMENT CANCELLED <br />ASSESSMENT CANCELLED <br />ASSESSMENT CANCELLED <br />George & Katie Krossberg, 3649 Highland Ave. <br />Parcel 057-285-090 $4.62 <br />Marian Dawson, 1971 Alameda de las Pulgas <br />Parcel 069-191-040 $19.60 <br />021 '61 <br />ASSESSMENT CANCELLED <br />ASSESSMENT CANCELLED <br />
