Invocation led by Reverend George Spindt, Messiah Lutheran Church. ON ROLL CALL the following were noted present: Councilmen Robert H. Bury, Floyd D. Granger, Mary W. Henderson, Paul C. Keckley, Herbert G. Petersen, John S. Rosselli, Mayor Sidney D. Herkner and City Clerk Helen C. Moore. Also noted present were City Manager Howard C. Ullrich, City Attorney Richard E. Gardella, Assistant City Manager Henry V. Burget, Police Chief William Faulstich, Director of Public Works J. Louis Scherer, Planning Director Ken Schroeter, Auditor Accountant Jack Ference, Chief Building Official Charles Gyselbrecht, and Deputy City Clerk Marian McCrindle Councilman Keckley moved to approve Minutes of Regular Meeting of September 11, 19675 as mailed, seconded by Councilman Rosselii and carried. PUBLIC HEARING, Resolution of Intention of the Planning Commission to amend the Zoning Map to rezone property from IP District to IR -A District, Southerly side of Broadway between Woodside Road and the spur tracks, being the northwesterly 122 -feet -in -width by 150 -feet -in-depth portion of Lot 1, Block 4, Redwood Indus- trial Tract .No. 1, owned by Land Development and Investment Company, declared open and affidavits of publication and mailing ordered filed. Planning Commission ini-tiated this action to rezone the property described from IP to IR -A, at the request of the Council because applicants asserted notice of the previous public hearing held by Council had not been received by them and requested reconsideration be given their rezoning request since they had not had the opportunity to appear in their own behalf. Council had denied the rezoning at the public hearing of July 10, 1967. Report of the Planning Commission was read in which it was stated a public hearing had been held on August 8th, at which no protests were received, and Commission had voted unanimously to recommend to the City Council to amend the Zoning Map to rezone property described from IP District to IR -A District. Commissioners directed Staff to transmit to City Council a full statement of considerations given, and, that as a matter of record, it be noted that Planning Commission would turn down any Use Permit application for a service station if the intention of developing the area as a unit, with a restaurant and motel, were not fulfilled within a reasonable time, and, that in such an event, the Commission would enter- tain a Resolution of Intention to rezone property back to its original zone classi- fication. 0 sp is •s7
