Staff report was read reviewing background information on this parcel when <br />Planning Commission had recommended rezoning as requested by applicant, Rinker <br />Development Corporation. <br />Paul Kelly, Attorney representing Rinker Development Corp., <br />expressed appreciation for Council's allowing reconsideration of <br />this rezoning. Mr. Kelly advised Council of the firm commitments _ <br />now delivered and on file with the City Attorney's office cover- <br />ing a binding 20 -year lease, with a 10 -year option to renew, <br />with the "Sir George Restaurant", a Southern California restau- <br />rant firm, to build a restaurant on this property, together with <br />a written commitment from the United California Bank, of Ana- <br />heim, Calif., for financing construction of a restaurant up to <br />$100,000; also a commitment from the Mobil Oil Co. for purchase of <br />property for construction of a service station, conditioned upon <br />restaurant being constructed on adjacent parcel, together with a <br />warranty from Rinker Development Corp. that the restaurant would <br />be constructed. He stated he felt filing of this evidence should <br />overcome Council's apprehension that service station would be <br />built without the restaurant also being built. He advised an <br />application had now been filed with the Planning Commission for <br />a Use Permit to construct the restaurant facilities. <br />Council questioned further details concerning restaurant ownership, operation, <br />and size proposed, besides questioning plans for motel also proposed on this <br />property. <br />Mr. Kelly advised building for restaurant to be some 6,000 <br />sq. ft. with a seating capacity of 200; advised restaurant firm <br />is well established in Southern California,; that operation <br />would also not include any liquor license. He also advised <br />financing for the motel project is not yet available. <br />City Attorney, in reply to question on whether rezoning requested could be <br />granted for a specific period to insure both facilities proposed, similar to <br />granting a. Use Permit for a specific period, advised a rezoning made now could <br />always be rezoned back to previous zoning, if Council felt justified. Council <br />also questioned whether it was thought not economically feasible to withhold this <br />rezoning to allow the service station until the restaurant and motel commenced. <br />Mr. Kelly advised it would be impossible to proceed on this <br />basis as finances going into restaurant construction also <br />coming from sale of property to the proposed service station <br />and sale of property conditioned explicitly on construction <br />of the restaurant, making a financial package for both facilities. <br />Discussion held on details of recommendation made by the Planning Commission con- <br />cerning conditions to be met prior to granting of Use Permit for service station, <br />and indication from Council that safeguards were present to insure development <br />stages requested by the Council. <br />The Council also questioned design, construction and landscaping proposed for <br />service station to enhance the property. It was pointed out A -Combining Dis- <br />trict proposed with the rezoning would insure Architectural Review. <br />Councilman Rosselli moved to close the public hearing, seconded by Councilman <br />Keckley and carried. <br />Councilman Keckley moved to introduce Ordinance adding Section 60.3.20 to <br />Ordinance No. 1130, the Redwood City Zoning Ordinance, rezoning property in the <br />vicinity of Broadway and the Woodside Expressway, seconded by Councilman Bury and <br />carried. <br />
