475 <br />allow a pharmacy, etc., subject to first securing a Use Permit, within any <br />medical or dental clinic or laboratory now or hereafter established in any PO <br />District existing or hereafter created, but not applying to such clinics in <br />those districts with the 0 -Combining Districts. Report also stated there were <br />14 specific PO Districts within the City, with just one, the present Redwood <br />Medical Clinic and a proposed new medical office building, adjoining residen- <br />tial district. <br />Further review also recited as to history of the Redwood Medical Clinic being <br />established by virtue of a Use Permit in 1958 which specifically prohibited <br />inclusion of a pharmacy; reviewed zoning history of the area, and present in- <br />clusion in the PO District under Zoning Ordinance No. 1130, similarly con- <br />taining prohibition against pharmacies within medical clinics. <br />Report further outlined review which had been made of other Zoning Ordinances <br />in the Bay Area which resulted in ascertaining that Redwood City's Zoning <br />Ordinance is the only one with this specific prohibition against pharmacies <br />within medical clinics in non-commercial zoning districts. The report con- <br />cluded with following findings: <br />1. Prohibiting a prescription pharmacy within a medical clinic <br />will neither help nor hurt the surrounding neighborhood. <br />2. Permitting a prescription pharmacy within a medical clinic will <br />neither help nor hurt the surrounding neighborhood. <br />Frank Hannig, Attorney for Redwood Medical Clinic, <br />briefly reviewed history of this application and its <br />now having been formally recommended by the Planning <br />Commission for amendment to Zoning Ordinance to bring <br />more into line with similar ordinances in our area. He <br />also reminded Council proposed amendment, if approved, <br />still would not permit pharmacies in any medical or <br />dental clinic as use permit would still have to be <br />granted. He felt following points important in <br />Planning Commission and Staff reports: <br />a. Staff report stated prohibiting or permitting a <br />prescription pharmacy within a medical clinic would <br />neither help nor hurt the surrounding neighborhood. <br />b. Staff reported no similar Zoning Ordinance containing <br />prohibition of such pharmacies in medical or dental <br />clinics had been found in their survey of Bay Area. <br />Mr. Hannig advised in research made by his clients, no <br />similar prohibition had been found in whole of United <br />Stated and felt this proved City's Zoning Ordinance out of <br />symmetry with other zoning ordinances. He also discussed <br />importance of consideration of right for free enterprise and <br />not as an infringement of other pharmacies, but meant to <br />offer a full medical service to patients within the clinic, <br />as done in all other cities. <br />Robert Dell'Ergo, Attorney, stated he was representing same <br />— group of pharmacies as he had represented through Planning <br />Commission procedures protesting amendment to Zoning Ordinance <br />which would allow pharmacies in medical clinics. <br />He read letter he received from R. E. Cooper, Manager of Ben <br />Franklin Store, Broadway and Middlefield, protesting per- <br />mitting a pharmacy at the Medical Clinic in interest of the <br />Redwood City downtown merchants, as felt any change in zoning <br />to allow commercial establishments to locate outside of esta- <br />blished areas would be detrimental to downtown area. <br />Mr. Dell'Ergo also submitted a series of 12 petitions bearing <br />names of individuals throughout the City which he stated to <br />
