476 <br />best of his calculations represented some 100 active <br />businesses in the City, which petitions were signed under <br />title "Petition in opposition to Birch Properties' Appli- <br />cation" and stating they were protesting any action of the <br />City which would make the Redwood Medical Clinic eligible <br />for the establishment of a pharmacy or any other type of <br />commercial activity. <br />Mr. Dell'Ergo stated certain aspects should be considered _ <br />in this issue: <br />1. Although coming before Council as a proposed amendment <br />to the Zoning Ordinance is in point not an amendment <br />for general application, but on initiative of one parti- <br />cular property owner, not on initiative of Council of <br />Staff. <br />2. Even if proposed as a general application of zoning <br />ordinance, must be considered with other relevent parts <br />of the ordinance. <br />Mr. Dell'Ergo reviewed history of the medical clinic from its <br />having been granted a Use Permit with express restriction <br />prohibiting a pharmacy, and of again attempting to get the <br />zoning ordinance changed in 1963 and 1964 which was again <br />refused by Council. He also cited examples in proposed <br />amendment which he felt needed further study as to impli- <br />cations of its application which he felt to be defective _ <br />but urged proposed amendment not be adopted. <br />Mr. Dell'Ergo asked for permission for those present pro- <br />testing this matter to indicate their presence by standing. <br />Mayor Herkner also asked that those favoring this proposal <br />to so indicate their presence. <br />Mr. Harvey Bourland, 1837 Maddux, questioned results of sur- <br />vey by Attorney Hannig and expressed his opposition to per- <br />mitting pharmacies in medical clinics. <br />Councilman Bury questioned manner in which pharmacy would be operated should <br />permission be granted through the proposed amendment to the Zoning Ordinance. <br />Mr. Hannig advised Redwood Medical Clinic would follow <br />State law procedures recently passed which prohibits <br />doctors themselves from owning and operating pharmacies. <br />The pharmacy would be necessarily leased out for operation <br />by a pharmacist within the building. <br />Councilman Petersen questioned Federal investigation being now made concern- <br />ing doctors having interest in establishments in which their own prescriptions <br />were dispensed. Councilman Keckley asked whether applicant would object to <br />deletion of phrase "or other sales or services" in amendment proposed and was <br />advised by Attorney for the applicant that it would be acceptable. <br />Further discussion and questioning held on ethics and existing laws govern- <br />ing relationship between doctors and pharmacies within their establishments. <br />Councilman Petersen questioned point made concerning implications in the <br />proposed amendment relating to other types of sales which could be permitted. <br />Councilman"Keckley commented on survey mentioned and conclusion indicated <br />that all of the area around the hospital might result in PO zoning eventually. <br />Councilman Henderson questioned possible effect to downtown merchants if phar- <br />macy allowed in this area. <br />Madelyne Cohen of Brewster Pharmacy, questioned pro- <br />cedures proposed in operation of pharmacy in the Red- <br />wood City Medical Clinic, if approved. <br />F. W. Hageboeck, Secretary -Treasurer, explained phar- <br />macy would be operated in same manner as any other <br />pharmacy. <br />
