415 <br />Consideration of Grading Ordinance. <br />Councilman Granger moved to table this ordinance at this time, as he wasn't con- <br />vinced ordinance prepared covered points desired, seconded by Councilman Petersen <br />Councilman Keckley asked when ordinance could be released after a tabling motion, <br />and was advised by City Attorney could be released at any time Council desired. <br />'— Motion to table ordinance lost on roll call vote, Councilmen Granger, Petersen <br />voting yes, Councilmen Bury, Henderson, Keckley, Rosselli and Mayor Herkner voting <br />no. <br />Councilman Bury felt intention not to take action on ordinance as now prepared had <br />merit as felt it lacked standards but full of requirements, whereas regulations <br />and controls needed for protection of those acquiring homes in graded areas. <br />Councilman Keckley expressed concern for additional liability which would be <br />imposed on Redwood City. City Attorney advised liability would be increased if <br />ordinance proceeded beyond setting standards and specifications provided in <br />ordinance. <br />City Manager advised preliminary draft of Ordinance had included 500 cu. yd. <br />provision for control but had been changed to the 1000 cu. yd. to avoid affecting <br />individual lot owners wanting to move earth. Councilman Keckley expressed con- <br />cern for costs to individual lot owners by imposing restrictions, and suggested <br />a scale beginning with 200 cu. yds, with no permit need, permit being required <br />thereafter after Staff investigation. <br />Councilman Rosselli asked whether Staff recommended adoption of ordinance as now <br />prepared. City Manager advised Staff position remains the same as previously <br />stated, that if Council desires to adopt a Grading Ordinance, ordinance as sub- <br />mitted, together with provisions of existing ordinances, will control movement of <br />earth in Redwood City. He further stated little hill area left in Redwood City <br />subject to massive grading, since although Edgewood Hills site is within the City <br />limits, if accepted for college site, would not be subject to grading ordinance. <br />The only other site remaining in Redwood City which might be considered for grading <br />would be Motorcycle Hill but for which grading could be controlled due to City <br />reservoirs at the site. <br />City Manager stated from managerial and administrative aspect he would prefer that <br />no grading ordinance be adopted at this time as he didn't think it was needed, <br />-- but if Council as policy desired to pass a grading ordinance, that proposed would <br />adequately do the job. Councilman Rosselli questioned liability of City with pro- <br />posed ordinance. City Manager advised this was main point why ordinance as <br />submitted contained only minimal standards for less liability. Councilman Ros- <br />selli questioned controls for moving of earth under the 1000 cu. yds, and was <br />advised by City Attorney of Building Code features. <br />
