360 <br />Councilman Rosselli moved to reappoint Frank Guida for another term on the Personnel <br />Board, seconded by Councilman Keckley and unanimously carried. (MINUTE ORDER #68-17) <br />Mayor Herkner asked that Council consider item relating to "PO" and 110" Districts, if <br />no objection, because of the many persons present and interested in this item. <br />Recommendation of Planning Commission concerning "permitted and conditionally permitted <br />uses" in "PO" ana "0" Districts. <br />Recommendation of Planning Commission read in which following redraft of the <br />Zoning Ordinance provisions submitted for Council's consideration: <br />"Section 11.4.(b). Medical and dental clinics and labora- <br />tories, not including the manufacture or distribution of <br />pharmaceutical or other products, but including prescrip- <br />tion pharmacies; provided, however, that said pharmacies <br />shall be located entirely within the main building, and <br />shall not be provided with outside entrances or signs, <br />and provided further, that sales therefrom shall be con- <br />ducted without display of products or advertising displays." <br />Councilman Rosselli questioned City Attorney if any conflict of interest would <br />prohibit him from participating in proposed discussion and voting on any action <br />proposed on this issue inasmuch as he did own an interest in the Lock Drug Company. <br />City Attorney advised that in his opinion nature of amendment proposed being one <br />of a general nature, not relating to any particular property, but similar to other <br />amendments to the Zoning Ordinance affecting the City generally, he believed no <br />conflict of interest present. <br />Eugene J. Majeski, Attorney appearing on behalf <br />of a medical clinic, took exception to the City <br />Attorney's ruling that no conflict of interest <br />is present in this instance. <br />Based on previous history of this issue and adjudications previously made, <br />Councilman Rosselli moved that this matter be tabled, seconded by Councilman Granger, <br />and lost on roll call vote, Councilmen Bury, Henderson, Keckley and Mayor Herkner <br />voting no, Councilmen Granger, Petersen and Rosselli voting yes. <br />Further discussion held concerning type of discussion and action proposed for <br />hearing this issue and of whether to allow a full presentation to be made by those <br />present for this purpose in order Council might establish guidelines to procedures <br />which would be needed hereafter. <br />Questions were asked concerning any other possible conflict of interests of <br />other Council members. City Attorney advised that he would state that all of <br />Council are qualified to vote when the Council is only to make a decision whether <br />this matter should be referred back to the Planning Commission or not. <br />Mayor Herkner announced, if no further objection by Council members on procedures, I <br />15 minutes would be allowed for presentation of each side of this issue. <br />Mr. Majeski, Attorney stated his review of other zoning <br />ordinances on West Coast and all other of Continental <br />United States, to his knowledge, indicated Redwood City's — <br />Zoning Ordinance is not in accord with such other ordinances <br />in respect to this one point of allowing pharmacies in <br />medical buildings in their PO Districts, and urged Council <br />consider the recommendation of the Planning Commission to <br />permit prescription pharmacies as a normal function of a <br />medical building. <br />,0 Is *66 <br />
