10. HultiPurpose Room/Community Center, <br />a. The parties hereto contemplate that a multipurpose <br />room/community center will be included in Phase I of school facility <br />construction by District for the Sandpiper Joint Use Site, provided that <br />the District's share of the cost of building the multipurpose <br />room/community center does not exceed $1,000,000. If the District's <br />share of the cost of building the multipurpose room/community center <br />exceeds $1,000,000, District, at its option, may defer construction of -- <br />the multi-purpose room/community center to a later phase. For purposes <br />of this paragraph only, the calculation of "the District's share of the <br />cost of building the multi-purpose room/community center" shall be <br />limited to the District's share of (1) the capital construction cost of <br />the multipurpose room/community center, (2) any fixtures included as <br />part of the approved design of the center, and (3) a prorata share of <br />design costs based on square footage of the center as compared to total <br />square footage of all structures included in the approved design for the <br />Joint Use Site. The cost of any parking that may be associated with use <br />of the multipurpose room/community center shall not be included in the <br />calculation of the District's share of the cost for purposes of this <br />paragraph. All costs associated with the design and construction of the <br />multipurpose room/community center shall be shared by City and District <br />as follows: fifty-six percent (56%) shall be paid by City, and forty- <br />four percent (44%) shall be paid by District. <br />b. District shall have exclusive use of the multi-purpose <br />room/community center on week days while school is in session, from the <br />hours of 8:00 a.m. to 4:00 p.m. For purposes of this Agreement, the <br />13 <br />ATTY/AGR/2017/AMENDMENTS/AMEND NO. 1 TO JOINT USE AGREEMENT - SANDPIPER <br />REV: 03-02-17 JS Page 20 of 42 <br />
