District, and such other agencies as may have approval authority under <br />law, bids shall be solicited for construction of the entire project. <br />The bid process shall comply with all pertinent requirements of local, <br />State and Federal law, including provisions of the City's Charter and <br />the State Education Code relating to the bidding of capital construction <br />projects. <br />d. City shall be lead agency for the construction phase of the <br />project and shall put the project out to bid. The bid process shall <br />comply with the requirements of state and local law applying to school <br />construction projects and city construction projects. District shall <br />have the right to approve the selection of any contractor or contractors <br />selected through the bid process. Any and all construction contracts <br />shall be awarded to the lowest responsible bidder, in accordance with <br />applicable requirements of local, State and Federal law. <br />20. Comaliance with California Environmental Oualitv Act. <br />City shall serve as lead agency under the provisions of the <br />California Environmental Quality Act, Public Resources Code section <br />21000 et seq. (110EQA11), and shall be responsible for conducting such <br />environmental review as is necessary for the entire Sandpiper Joint Use <br />Site. District shall act as a responsible agency under CEQA. <br />21. Hold Harmless. <br />a. City shall indemnify and hold harmless District, its officers, <br />agents and employees against any and all claims, causes of action, suits <br />or judgments, for death or injuries to persons, or loss of or damage to <br />property, resulting from the negligent acts of City, its officers, <br />agents, employees or invitees in the performance of this Agreement.
