FRANCHISE VIOLATIONS. In the event that Grantee <br />commits any of the following acts or omits or fails to perform any <br />of the following, such acts or omissions shall constitute a default <br />and breach of Grantee's obligations pursuant to this franchise: <br /> (a) Failure to perform any of its material obligations under <br />this franchise or pursuant to any other agreement between the <br />Grantor and the Grantee related to the CATV system. <br /> (b) Performance as to quality of service, and response to <br />subscriber complaints which demonstrates a continuing, willful <br />pattern of inadequacy, which has not been corrected by Grantee <br />after due notice by Grantor. <br /> (c) Failure to provide or maintain in full force and effect, <br />the liability and indemnification coverages or the performance bond <br />as specified in Section 8 of this franchise. <br /> (d) Frequent violation of any orders or rulings of any <br />regulatory body having jurisdiction over the Grantee relative to <br />this franchise unless such orders or rulings are being contested by <br />the Grantee in a court of competent jurisdiction. <br /> (e) Any attempt to evade any of the provisions of this <br />franchise or to perpetrate any fraud or deceit upon the Grantor. <br /> (f) Insolvency, inability or unwillingness to pay its debts, <br /> 16 <br /> ,.--.....- >-~>_.- <br />
