Section 12.18 Article 78 (commencing with 78.101) of the Fire Code <br />is hereby amended to read as follows: <br />"ARTICLE 78 <br />FIREWORKS <br />"'Section 78.101 'Fireworks' shall mean and include any combustible <br />or explosive composition, or any substance or combination of substances, <br />or device prepared for the purpose of producing a visible or an audible <br />effect by combustion, explosion, deflagration or detonation, and shall <br />include blank cartridges, toy pistols, toy cannons, toy canes, or toy <br />guns in which explosives are used, firecrackers, torpedoes, skyrockets, <br />Roman candles, Daygo bombs, sparklers, or other devices of like <br />construction and any devices containing any explosive substance, except <br />that the term 'fireworks' shall not include any auto flares, paper caps <br />containing not in excess of an average of 25/100ths of a grain of <br />explosive content per cap, and toy pistols, toy canes, toy guns or other <br />devices for use of such caps, the sale and use of which shall be <br />permitted at all times. <br />"'Section 78.102 The manufacture of fireworks within the City is <br />prohibited except under license duly issued by the State Fire Marshal and <br />under permit issued by the Chief, which permit shall include such <br />reasonable conditions and requirements as, in the opinion of the Chief, <br />are necessary or proper to eliminate hazard to property or danger to any <br />person. <br />"'Section 78.103 (a) It shall be unlawful for any person <br />including fair associations, amusement parks, or other organizations, or <br />artisans in pursuit of their trade) to possess, store, use or explode any <br />fireworks for public displays of fireworks, except pursuant to a permit <br />issued hereunder by the Chief for a supervised public display of <br />fireworks. <br />-15- <br />
