r <br />_"'(b) The Chief shall have the authority to adopt reasonable rules <br />and regulations for granting of permits for supervised public displays of <br />fireworks, and such permits shall include reasonable conditions and <br />requirements as in the opinion of the Chief are necessary or proper to <br />eliminate hazard to property or danger to any person. <br />"'(c) Every such use or display shall be conducted by an operator <br />approved by the Chief, and shall be of such character and so located, <br />discharged or fired as in the opinion of the Chief after proper <br />investigation, so as not to be hazardous to property or endanger any <br />person. <br />"'(d) Applications for permits for supervised public displays of <br />fireworks shall be made in writing and filed with the Chief at least ten <br />(10) days in advance of the proposed date of the display. After such <br />privilege shall have been granted, possession, storage, use, distribution <br />and explosion of fireworks for such display shall be lawful for that <br />purpose only. No permit granted hereunder shall be transferable. <br />"'(e) The person applying for a permit for a supervised public <br />display of fireworks shall, at the time of application, submit for <br />inspection the applicant's license issued by the State Fire Marshal, and <br />furnish proof of coverage of such compensation insurance as is required <br />by the State of California for any employees of the applicant. The <br />applicant shall file with the Chief a bond issued by an authorized surety <br />insurance company to be approved by the City, conditioned upon the <br />applicant's payment in an amount approved by the City (and in no event <br />less than that required by State law) of all damages to persons or <br />property, including loss of life and loss of use of property, which shall <br />or may result from or be caused by the proposed supervised public display <br />of fireworks, or any negligence on the part of the applicant, or the <br />applicant's agents, servants, employees, or subcontractors in the <br />presentation thereof, or a certificate evidencing the carrying of <br />appropriate public liability insurance for the benefit of the applicant <br />and the applicant's agents, servants, employees and subcontractors, as <br />evidence of ability to respond in damages in at least such amount, said <br />insurance likewise to be approved by the City. <br />-16- <br />
