During initial construction of BISDPS in March 2014, it was discovered that a sanitary <br />sewer force main operated by Silicon Valley Clean W ater (SVCW) was within the <br />immediate vicinity of the project site. Work was suspended in consideration of the risk to <br />the SVCW sewer pipeline. Since the initial suspension of construction for the BISDPS <br />project in July 2014, SVCW constructed a new sanitary sewer force main pipeline, <br />which began operating in the fall of 2015. This development prompted the City to lift the <br />suspension of construction for the Bair Island Storm Drain Pump Station on October 1, <br />2015. <br /> <br />At their December 10, 2015 meeting, the SVCW Commission declared an “Emergency <br />Condition” after SVCW staff detected leaks on their sewer pipe near the SVCW- <br />operated Maple Street Sanitary Sewer Pump Station. SVCW’s emergency condition <br />meant that SVCW’s original sewer force main near the Bair Island Storm Drain Pump <br />Station would need to be operational and the City would need to temporarily suspend <br />the construction of BISDPS again. In August 2016, the sanitary sewer force main that <br />was near the BISDPS project site was fully decommissioned by SVCW and the BISDPS <br />construction was able to resume. <br /> <br /> <br />ANALYSIS <br />During the suspension of the BISDPS project, the main supplier for the specialized <br />equipment and material needed for the pump station was not able to come to an <br />agreement with the general contractor, Sanco Pipeline Inc. As a result, the previous set <br />of materials and equipment submitted and reviewed by the City and processed by West <br />Yost Associates, Inc. were no longer valid and new submittal packages were provided <br />by the general contractor regarding pump station components such as the pumps, <br />sensors, generators, and motor controls. This unexpected change of supplies resulted <br />in additional time and cost by the consultant, West Yost, to process and handle the <br />review of all the new material and equipment submittals and make recommendations of <br />acceptability. <br /> <br />Furthermore, construction of the Marriott Hotel started on the same property as the new <br />pump station in 2014. Two construction projects occurring simultaneously on or near the <br />same site required additional communication efforts, scheduling of construction <br />activities and periodic coordination from West Yost with the BISDPS contractor, the <br />hotel developer and the hotel contractor. <br /> <br />As a result of the numerous suspensions and construction issues, West Yost will <br />provide more services than were expected with their original contract of $187,049.00. <br />With the contract amendment of $48,654.00, West Yost will provide additional services <br />for inspection of construction, handling of contractor progress payments, submittals, <br />request-for-information and other construction documents, as well as provide additional <br />construction schedule monitoring and additional project document review and <br />construction coordination. The consultant’s charges will be based on West Yost’s hourly <br />rate and fee schedule included in the contract amendment, which are the same rates <br />set in the original contract from 2014 without any increase. <br />6.1.A. - Page 2
