The Notice Inviting Sealed Bids <br />requested bidders to sign and date the Specification Sheet. Towne Ford signed, but did <br />not date, the Specification Sheet. Staff recommends that the City Council waive this <br />minor irregularity and accept Towne Ford’s bid as the irregularity was not the result of <br />fraudulent intent on the part of the bidder and the best interests of the public would be <br />served by such waiver. This decision is authorized by the Notice Inviting Sealed Bids <br />and Section 2.68(C) of the Purchasing Ordinance. The Notice Inviting Sealed Bids <br />states: <br /> <br />The right is reserved, as the interest of the City may require, to purchase <br />individual equipment, materials, vehicles or supplies from more than one <br />Bidder or all equipment, materials, vehicles or supplies from one Bidder, to <br />reject any or all bids, to waive any informality in bids, and to accept, <br />modify, or reject any items of the bid. <br /> <br />Section 2.68(C) of the Purchasing Ordinance states: <br /> <br />“The Council may waive any irregularities in bids received or permit the <br />correction of erroneous bids when the Council finds that the irregularity or <br />error was not the result of fraudulent intent on the part of the bidder and <br />that the best interests of the public would be served thereby.” <br />6.1.I. - Page 2
