The recommended action is to award the bid to Towne Ford because they are the lowest responsible bidder to meet the vehicle requirements in the bid specifications. Towne Ford’s bid did contain one minor irregularity. The Notice Inviting Sealed Bids requested bidders to sign and date the Specification Sheet. Towne Ford signed, but did not date, the Specification Sheet. Staff recommends that the City Council waive this minor irregularity and accept Towne Ford’s bid as the irregularity was not the result of fraudulent intent on the part of the bidder and the best interests of the public would be served by such waiver. This decision is authorized by the Notice Inviting Sealed Bids and Section 2.68(C) of the Purchasing Ordinance. The Notice Inviting Sealed Bids states: The right is reserved, as the interest of the City may require, to purchase individual equipment, materials, vehicles or supplies from more than one Bidder or all equipment, materials, vehicles or supplies from one Bidder, to reject any or all bids, to waive any informality in bids, and to accept, modify, or reject any items of the bid. Section 2.68(C) of the Purchasing Ordinance states: “The Council may waive any irregularities in bids received or permit the correction of erroneous bids when the Council finds that the irregularity or error was not the result of fraudulent intent on the part of the bidder and that the best interests of the public would be served thereby.” 6.1.I. - Page 2
