The revisions to the Project plans or proposals made, or agreed to be <br />made before the proposed Mitigated Negative Declaration was released to the <br />public for review would avoid the effects and mitigate the effects to a point where <br />clearly no significant effect on the environment will occur and, on the basis of the <br />whole record before this Board (including the Revised Initial Study and any <br />comments received), there is no substantial evidence that (1) the Project will <br />have a significant effect on the environment and (2) all the potential significant <br />effects have not been mitigated or avoided by the changes or alterations which <br />have been required in, or incorporated into, the Project. <br />9. The Mitigated Negative Declaration was revised after public review and <br />before adoption but was not substantially revised because: <br />• New project revisions are added in response to comments on the project's <br />effects identified in the proposed Mitigated Negative Declaration which are not <br />new avoidable significant effects; <br />• Measures or conditions of project approval are added after circulation of <br />the proposed Mitigated Negative Declaration which are not required by CEQA, <br />which do not create new significant environmental effects, and are not necessary <br />to mitigate an avoidable significant effect; <br />• New information is added to the Mitigated Negative Declaration which <br />merely clarifies, amplifies, or makes insignificant modifications to the Mitigated <br />Negative Declaration. <br />10.
