<br />CGM:sw:4/24/78R <br /> <br /> <br /> <br /> <br /> <br />(1) That all deficiencies of the City's Building <br />and Fire Regulations existing at the project <br />have been corrected. <br /> <br />(2) That all areas of the project that are damaged <br />or infested as shown in the structural pest <br />report have been repaired or replaced. <br /> <br />(3) That the property report submitted by the <br />developer is accurate. It shall require the <br />developer to amend such report if it finds <br />that a statement contained therein is without <br />foundation in fact. <br /> <br />(4) That the project is consistent with the City's <br />General Plan and the Housing Element of the <br />General Plan. <br /> <br />"In the event a project which is a conversion does not <br /> <br />comply with this article, and with the requirements of appli- <br /> <br />cable ordinances of the City, the permit may be granted by the <br /> <br />Planning Commission if the Planning Commission finds: <br /> <br />(a) That granting the Condominium Permit will not be <br />detrimental to the health, safety, peace, morals, <br />comfort or general welfare of: <br /> <br />(i) persons in the immediate neighborhood, <br /> <br />(ii) persons in the City, and <br /> <br />(iii) property in the immediate neighborhood; <br /> <br />(b) That because of circumstances applicable to the <br />subject property or to the structures situate thereon, <br />including (but not limited to) the size, shape, <br />location or surroundings of the subject property or <br />the buildings situate thereon, the strict application <br />of the provisions of this article would create an <br />unreasonable economic hardship on the developer of <br />the proposed project; and <br /> <br />(c) That granting the Condominium Permit for the project <br />not in strict conformance with the development <br />standards of this article, will, subject to such <br />conditions as may be imposed thereon: <br /> <br />(1) Provide for substantial compliance with such <br />development standards, and <br /> <br />(2) Incorporate mitigating features in the project <br />which tend to further the purposes of this article. <br /> <br /> <br /> <br /> <br /> <br />-9- <br /> <br /> <br /> <br /> <br /> <br />r <br />
