MINUTE ORDER 04-209 D. Council Member Ira Ruskin Assembly Seat Update Mayor I ra asked City Attorney Yamamoto to provide any legal information and parameters regarding the vacancy. City Attorney Yamamoto stated that according to the City's Charter, Section 9, whenever a vacancy occurs it is the Council's opportunity to make an appointment. Starting with the first day of the vacancy, the Council has a 60 day period of time to make an appointment. The appointee would need to be a resident an elector of city for at least 30 days prior to the appointment. The appointee would serve in the office until such time as there is a regular Municipal Election and at that time the Council position is then up for election for the remainder of the term that existed. Should the Council not make an appointment within the 60 day period, the Council would then be obligated to call for an election to be held to fill the position. Public Comment: Vance Smith offered his congratulations to Ira Ruskin and appreciated his resigning in a manner that Council can go forward to appoint someone in the community. He stated his amusement in that the Council has a selection process in which Council Member Bain was appointed several years ago and Bill Stangel was appointed years before that. The process was based on the next largest number of votes for the Council positions in the last election. If that is the case, he stated that someone he knows as a past Council Member and past Chairperson of the Planning Commission, Paul Sanfilipo, has served on numerous boards in govef'Dmer.t, business and entrepreneurial. He stated that there is no need for a process or going to a vote. Jeff Filippi congratulated Ira Ruskin and spoke on behalf of Paul Sanfilipo, stating his pride in running Mr. Sanfilipo's last campaign. He encouraged the last process be used, pointing to Mr. Sanfilipo having coming in next in votes after the successful candidates, possessing proven leadership skills, good working with others, is honest and ethical. Paul Sanfilipo congratulated Ira Ruskin on his victory and reminded Council that he is still interested in working on the City Council to help build and maintain a more vibrant Redwood City.
