13. The top vendors may be contacted by the staff of the PaL,,,,, Recreation and 2 Community Services staff to meet and provide a short presentation on their bid packets ~s.well as t~eir experience in providing aerobics programs and strategies on provIdmg aerobIcs at Red Morton Community Center 14. The Vendor will adhere to all requirements stipulated in the attached "Grant of Revocable Permit for Aerobic Classes at the Red Morton Community Center". B. TERMS OF THE CONTRACT 1. The contract for the aerobics program will begin on Monday, January 20, 1997 and run through Wednesday, December 31, 1997 2. The contract will be evaluated annually beginning November 1, 1997 and this discussion will be completed by November 30, 1997. Terms of the contract rental rates will be subject to an increase of no more than 5% of rental rate. Program evaluation criteria will be agreed to by the vendor and the City prior to the execution of any agreement and be included as a exhibit of that agreement. 3. The vendor will offer the following classes as part of the contract. a. Morning classes from 9:00-10:00 a.m. Monday through Sunday. b. Evening classes at 5:45 p.m. Monday through Friday. c. Evening classes at 7:00 p.m. Monday through Thursday. The vendor will have use of the aerobic/ dance studio in Red Morton Community Center for the classes. The room measures 40' x 80'. 4. Vendor will submit payment and payment verification receipts to the Redwood City Parks, Recreation and Community Services Department in the amount of $25.00 per hour or 20% of gross receipts, whichever is greater, for Monday through Saturday classes ànd $45.00 for Sunday classes or 20% of gross receipts, whichever is greater, by the 10th of each month. The vendor understands the payments are for the rental of the facility at the Red Morton Community Center and will pay for the aerobics class time even if a class is not held during that time slot, unless the class has been previously canceled by the City of Redwood City or Vendor under the conditions stated in this contract. 5. The City of Redwood City Parks, Recreation and Community Services does not consider the following programs in competition with this aerobics program and will continue to sponsor programs such as: adult sports, yoga, fitness room, senior step it up, gym tone fitness, tai chi, tae kwon do, dance classes and therapeutic recreation exercise and fitness classes. 6. The vendor will receive at least 1/2 page in the upcoming four (4) issues of the "CityWide" brochure". 7. Vendor understands that the City of Redwood City, on occasion can cancel class due to a departmental special event or facility need and will notify the Vendor no later than one month prior to the cancellation. 8. City of Redwood City understands that the Vendor, on occasion can cancel class due to a special event or needs and will notify the City of Redwood City no later than one month prior to the cancellation. 9. Each party to the agreement shall have the right to terminate the agreement, at any time, without cause, upon sixty (60) days prior written notice to the other party. -~,~". --
