7.5.10 Workers who take voluntary demotions, voluntary reductions in
assigned time, or who exercise the bumping rights listed in this
Article 7.5 shall be granted the same rights as workers laid off and
shall retain eligibility to be considered for reemployment in the full-
time or higher classification for two (2) years, provided that the
same requirements under which they qualified for appointment to
the higher classification shall still apply.
7.5.11 A worker may elect to be laid off in lieu of bumping. Accepting
such a layoff does not affect the worker's reemployment rights
under this Agreement.
7.5.12 Only workers who are or were members of the Bargaining Unit at
the time of a layoff shall have the bumping rights listed in this
Article.
7.6 Reemployment
7.6.1 The names of workers laid off shall be placed on a reemployment
list in inverse order of seniority. The worker with the greatest
seniority on the reemployment list shall be offered reinstatement
when a vacancy occurs in a classification such worker is qualified
to fill. Qualifications for a position shall be determined in the
manner provided in Article 7.5.1. In the event the worker refuses
two (2) offers of reemployment, said worker's name shall be
removed from the reemployment list unless said worker has rights
under Article 7.5.1 to a higher classification than the one in which
reemployment was refused. In hiring for a vacant position in a
classification, such reemployment list shall take precedence over
all other employment lists.
7.6.2 Any worker who accepts an offer of reemployment to the highest
classification he/she would have been entitled to at the time of
layoff shall have his/her name removed from the reemployment list.
7.6.3 Any worker who is laid off and is subsequently eligible for
reemployment shall be notified by the City in writing, sent by
certified mail to the last address given the City by the worker, of
any vacancies for which he/she is eligible. Workers so notified
shall respond within seven (7) working days of the date notice was
sent. Copies of all such reemployment notices together with a
listing of workers to whom they were sent shall be sent to the
Union.
11
.. ,. .. - .--_.". - ._~~..~ _....",- -.
