<br /> disabilities as set forth above. The length of such disability leave, <br /> including the date on which the leave shall commence and the date <br /> on which the duties are to be resumed, shall be determined by the <br /> worker and the worker's physician; however, the Human Resources <br /> Director may require a verification of the extent of disability through <br /> a physical examination of the worker by a physician appointed by <br /> the City at the City's expense. <br /> 20.6.2 Workers are entitled to leave without payor other benefits for <br /> disabilities because of pregnancy, miscarriage, childbirth, or <br /> recovery therefrom when sick leave has been exhausted. The date <br /> on which the worker shall resume duties shall be determined by the <br /> worker on leave and the worker's physician; however, the Human <br /> Resources Director may require a verification of the extent of <br /> disability through a physical examination of the worker by a <br /> physician appointed by the City. <br /> 20.6.3 The worker on leave shall be returned to her original position or if <br /> that position is not in existence to an equivalent position within her <br /> classification. A worker may incorporate a portion of her pregnancy <br /> leave into provisions of the Family and Medical Leave Act, as <br /> described in Article 20.13. <br />20.7 Court Appearance Leave <br /> 20.7.1 Leaves for court appearance shall be granted by the City for the <br /> following: Court appearance on the behalf of the City--no loss of <br /> salary will be incurred. <br /> 20.7.2 When a worker is required to appear as a witness in court, other <br /> than as a litigant, or to respond to an official order from another <br /> government jurisdiction for reasons not brought about through the <br /> connivance or misconduct of the worker, a leave without loss of <br /> salary shall be granted up to the amount of the difference between <br /> the worker's regular earnings and any amount he/she receives for <br /> witness fees. <br />20.8 Jury Duty <br /> Any worker whose name shall be selected from the list of trial jurors to serve as <br /> a juror in a civil or criminal action pending in a Superior, Municipal, or Justice <br /> Court of the State of California, or any Federal Court convening in the State of <br /> California, or any worker required to report for the selection of a jury in any of <br /> these courts shall receive pay for the time such service requires his absence <br /> 35 <br />
