<br />such position, shall be reinstated; provided, however, that such leave of absence <br />shall not extend beyond the term of this Memorandum, unless extended by <br />mutual consent. <br />20.12 Catastrophic Leave Donations <br />Workers covered by this Memorandum of Understanding are eligible to <br />participate in the City's Catastrophic Leave Program in accordance with the <br />current Catastrophic Leave Policy. The City will match worker contributions to <br />the catastrophic leave bank on a dollar equivalent basis up to an aggregate <br />maximum City contribution of seven thousand dollars ($7,000.00) per fiscal year. <br />20.13 Family and Medical Leave <br />20.13.1 In accordance with the California Family Rights Act of 1991 and the <br /> Family and Medical Leave Act of 1993, regular part-time and full- <br /> time workers with one year or more of service are entitled to leave <br /> to a maximum of 12 weeks in a 12-month period: <br /> 20.13.1.1 to care for a child following a birth or placement of a <br /> child with the worker for adoption or foster care; <br /> 20.13.1.2 to care for the spouse, child or parent of the worker <br /> who has a serious health condition; <br /> 20.13.1.3 if the worker is unable to perform his/her job because <br /> of the worker's own serious health condition. <br />20.13.2 When a worker desires leave for the above stated reasons, the <br /> worker should give 30 calendar days written advance notice to <br /> his/her immediate supervisor (or if the event is unforeseeable, <br /> worker should give as much notice as possible). <br /> The City may require that a request for family leave be supported <br /> by a certification issued by the worker's health care provider. <br /> Certification may also be required from the health care provider of <br /> the worker's child, parent or spouse who has a serious health <br /> condition before the worker is approved to use family/medical leave <br /> to take care of that family member. <br /> Failure to comply with the above requirements may lead to denial <br /> of leave. <br /> 37 <br />
