NOW, THEREFORE, in consideration of the stated recitals and other valuable <br />consideration, City and RCN agree as follows: <br />Section 1. Institutional Network ('"I-NET") <br />1. Implementation. <br /> <br /> (a) RCN shall construct, install, operate and maintain four (4) single mode <br />optical fibers between dedicated public agency buildings forming an Institutional <br />Network ("I-NET") for the exclusive use of the City. <br /> <br /> (b) Said I-NET shall be capable of distributing video, audio and data to all <br />designated City buildings connected to the I-NET. <br /> <br /> (c) RCN shall maintain and replace in a timely manner all network equipment <br />and communications paths that are part of the I-NET; provided, however, that RCN <br />shall not be required to provide, maintain or replace any end-user equipment. The City <br />shall be responsible for the purchase, maintenance and replacement of any end-user <br />equipment (both hardware and software) that it owns and operates, unless otherwise <br />specifically provided for in this CATV Franchise Agreement. <br /> <br /> (d) The I-NET shall comply in all respects with the terms and agreements <br />described in this document. <br /> <br /> (e) The four (4) single mode fiber-optic strands shall interconnect each of the <br />City buildings specified in Exhibit B to the City's demarcation point (City Library), and <br />the City will be responsible for the interconnection between the City Library and City <br />Hall. <br /> <br /> <br />
