(v) For scheduled I-NET maintenance activities, and scheduled RCN <br />Subscriber Network maintenance activities that may impact the I-NET, whether initiated <br />at the City's request or by RCN, RCN shall provide a minimum of one (1) calendar week <br />notice to the City's I-NET Administrator, unless otherwise agreed to by the City's I-NET <br />Administrator or other designed employee. <br /> <br /> (vi) For all Cable System maintenance activities likely to impact I-NET <br />service, scheduled or otherwise, RCN shall provide 3 business days notice to the City's <br />I-NET Administrator prior to the commencement of any such work. <br /> <br /> (vii) All requests for I-NET maintenance shall be coordinated by the <br />City's I-NET Administrator or other designated employee. <br /> <br /> (viii) In the event that the RCN Subscriber Network and the I-NET <br />experience an outage simultaneously, it is the understanding of the parties hereto that <br />RCN's first priority is to repair the Subscriber Network. <br /> <br /> (h) Upon the effective date of the I-NET Agreement, the City may use the I- <br />NET for any lawful municipal or public purpose acting in its governmental or proprietary <br />capacity, such purposes shall consistent with the City's municipal or public purposes <br />and it's charter, as amended form time to time, including city contracted non-profits <br />hosted at the city I-NET locations, provided, however, that City shall not lease or <br />sublease the I-NET provided by RCN to any non-governmental party nor use the I-NET <br />for commercial purposes, or use or permit the use of I-NET to provide services to third <br />parties in competition with services provided by RCN over the RCN facilities, other than <br />the governmental entities and entities that may be designated to manage and control <br />PEG channel.
