18.6.5 An employee may coordinate a portion of her maternity leave with provisions of <br />the Family and Medical Leave Act, as described in Section 18.9. <br />18.7 Leave for Pregnancy Disability <br />18.7.1 Employees who are working are entitled to use personal illness and injury <br />leave for disabilities caused or contributed to by pregnancy, miscarriage, <br />childbirth, and recovery therefrom on the same terms and conditions governing <br />leaves of absence for other illness or medical disability. Such leave shall not be <br />used for child care, child rearing, or preparation for childbearing, but shall be <br />limited to those disabilities as set forth above. The length of such disability <br />leave, including the date on which the leave shall commence and the date on <br />which the duties are to be resumed, shall be determined by the employee and the <br />employee's physician; however, the Human Resources Director may require a <br />verification of the extent of disability through a physical examination of the <br />employee by a physician appointed by the City at the City's expense. <br />18.7.2 Employees are entitled to leave without pay or other benefits for disabilities <br />because of pregnancy, miscarriage, childbirth, or recovery therefrom when sick <br />leave has been exhausted. The date on which the employee shall resume duties <br />shall be determined by the employee on leave and the employee's physician; <br />however, the Personnel Office may require a verification of the extent of <br />disability through a physical examination of the employee by a physician <br />appointed by the City. <br />18.7.3 The employee on leave shall be returned to her original position or if that <br />position is not in existence to an equivalent position within her classification. A <br />worker may coordinate a portion of her pregnancy leave with provisions of the <br />Family & Medical Leave Act, as described in Section 18.9. <br />18.8 Bereavement Leave <br />18.8.1 In the event of a death in the immediate family of an employee of the City, <br />that employee shall, upon request, be granted such time off with pay as is <br />necessary to make arrangements for and/or attend the funeral not to exceed three <br />(3) regularly scheduled working days or four (4) days in the event the funeral is <br />300 or more miles from the City. This provision does not apply if the death <br />occurs during the employee's paid vacation or while the employee is on leave of <br />absence, layoff or sick leave. <br />18.8.2 For the purpose of this provision, the immediate family shall be restricted to <br />father, mother, brother, sister, spouse, domestic partner, child, half brother, half <br />sister, stepbrother, stepsister, mother-in-law, father-in-law, grandparent, <br />grandchild, and stepfather, stepmother, stepchild in those cases where direct <br />child rearing -parental relationship may be demonstrated to have existed. <br />
